In for Jailer's Death—Murder Dur-
ing Jail Delivery With Girl's Bro-
ther Is Charged to Him.
Leavenworth, Kas., Nov. 30.—Jas.
Dalton, a life convict In the Kansas
penitentiary at Lansing since 1902,
received a parole from Gov. Stubbs
Tuesday, and left the prison a free
man. The governor had been cen-
tering Dalton's case for some tlma
and Dalton's friends were confident
of a pardon. He will return to his
former home near Goffs, Kas.
It was love for a girl, Laura Tay-
lor, who lived near Goffs. Kansas,
which was responsible for the crime
in which Dalton was Implicated, com-
mitted twelve years ago. Dalton es-
caped, enlisted In the army and serv-
ed four years In Cuba and the Phil-
ippines before he was brought into
court
According to the story brought out
at Dalton's thial, one of his sweet-
heart's brothers was In trouble fre-
quently. One day while at the Tay-
lor home three officers came to the
house looking for young Taylor and
two friends who were implicated in
some orfenso. The men wanted were
'in the house, but the elder Taylor
i prevented a search on a technicality
Dalton Induced to Help.
After the officers left the girl sug-
gested that Dalton drive the young
men to some point from which they
could escape from that section. Dal-
ton says he saw a chance to increase
the girl's affection and started with
the men, traveling over unused roads.
Just as he was leaving them a posse
surrounded and captured them.
They were taken to the county
Jail at Marysville. A plan to escape
was worked out by the party.
Dalton left first, without disturb-
ing the Jailer, he says. The others
followed. The Jailer, however, was
awakened and shot down by the
others. Dalton was to wail at
point outside the city where the
others were to Join him. Wher. (he
four arrived one of the fugitives told
Dalton the Jailer was awakaened and
It was necessary to "tap him on the
head" to complete the escape. Dal-
ton claims he did not know at the
time that the Jailer had been killed.
Served Two Enlistments.
Dalton left the otherB, he said, and
went to Denver, where he enlisted
under the name of Albert G. Denny,
In Company K, Fifteenth Infantry,
After being honorably discharged at
the close of the Cuban campaign he
re-enllstcd at Philadelphia In Com-
pany L, Fourth Infantry, and went to
the Philippines. After his return he
was arrested and taken to Marysville
for trial.
His army record and a doubt that
he had been directly Implicated In
the jailer's killing were the argu
ments used for his parole.
'I have no plans for the future,"
he said at the penitentiary. "I will
visit my old home first and expect
then to make my future plans. I an
deeply grateful to Governor Stubbs
for sis parole."

The earth beings involved in the
story are Happy Hana and Mike of
The Cat and the Fiddle" fame, aided
by the Genii, the good fairy—the
new play being a continuation of
their experiences. As Mr. Sellon Is
aided by some forty other personages
with a number of musical features
and song hits—and a car load of
gorgeous scenery and effects—theatre
goers here can be assured of an ev-
ening's pleasure.
The Cow and the Moon comes here
on Monday evening, December 5, at
the Becker.

AFTER DELINQUENTS
The street and brdigc fund is short
several thousand dollars, and the
road tax collector is getting corres-
pondingly active. He has a special
man out rounding up delinquents,
and his work Is bringing results.
Shawnee this year has not paid the
amount of road tax that her popula-
tion would Justify, ft should bo a
matter of public pride to have as
large a per cent of the adults of the
city pay their road tax as posgihle.
In a number of Texas cities, notably
Dallas there Is each year waged a
campaign by the newspapers and
commercial clubs for the payment of
this tat, which goes directly into
work that benefits the entire com-
munity.
