INSPECTOR SHAW OF TULSA CO.
GETS OUT ON HABEAS
CORPUS.
—o—
The criminal cpurt of appeals re-
leased A. J. fchaw, a Tulsa county
election inspector, Saturday, at Guth-
rie, when habeas corpus proceedings
were Instituted by Attorney W. A.
Ledbetter of Oklahoma City, who re-
presented the Inspector.
County Attorney Breckenrldge of
Tulsa county caused the arrest of
Shaw Tuesday, November 8, when he
denied a negro the right to vote on
an ex parte affidavit to the effect
that the holder theieof was a quali-
fied voter under the rocently enacted
law in Oklahoma county commonly
known as the grandfather clause, an
amendment to the constitution, pro-
viding that voters to be qualified must
be able to read and write and to in-
telligently construe a section of the
constitution of the United States.
The case was taken before the
criminal court of appeals for the pur-
pose of having it, the highest crimi-
nal court in the state, pass on the
question involved, since there are
many election inspectors throughout
the state refused to permit negroes to
vote on ex parte affidavits that they
were qualified to vote under the te-
nets of the grandfather clause.
Attorney Ledbetter will go to Gu-
thrie Monday duornlng to argue the
case before the criminal court of ap-
peals, when he will take the position
that election inspectors have the le-
gal right to satisfy themselves be-
yond mere ex parte affidavits as to
the competency of persons to vote In
any election.
