tion through protest or substitutes, the tribes turned to a strategy of crip-
pling the railroads by arguing over building materials, new rights-of-way,
taxes or any other area where Indian governments could assert their
sovereign powers to gain some hand in determining the economic future."
First the tribes strongly demanded that they, as common owners of the
lands, be paid for timber and stone taken from the Indian Territory and
that the federal officials disapprove attempts to make token payments to
individuals who happened to be residing along the right-of-way. Extensive
hearings upon this subject and upon the matter of coal mining in the
Territory, not authorized by any treaty, were held in the late 187os. The
Indians argued that the coal mines were under complete control of the
railroads, disguised only by a different corporate title and that the railroad
companies were not only using Indian resources to build the line through
