Shawnee’s Bribe
Whereas the matter of the reso-
lution made by the Mayor and
Councilmen of the City of Shaw,
nee which reads as follows; R" -
solved, by the Mayor and Council-
men of the City of Shawnee that
in the event the County of Pott-
awatomie, State of Oklahoma,
shall within twelve months from
this date desire to lease from aaid
Oily of Shawnee the City Hall
building of said city for the pur-
pose of Court rooms, county offi-
ces and jail, the Mayor and coun-
cilman will lease tne same to said
Pottawatomie County for the pe-
riod of ten years at an annual rent-
al of ten dollars per year,” has
been filed with the County Clerk
for the consideration of the Board
of County Commissioners, and the
matter having come up regularly
tor consideration, and the Board
being fully advised in the premis-
es finds:
That the Shawnee city hall is
not a suitable or adepuate build-
ing to be used as a County court
house and in which to carry on
the counties business for the fol-
lowing reasons.
First. There is not sufficient or
adequate fire proof vault space in
said city hall in which to keep the
county's various records.
Second. The rooms in said city
hall are not large enough or so
arranged as to be conveniently or
comfortubly used as offices for t he
various couat offices.
Third. There is no convenient
or suitable room in said city hall
for the holding of District Court,
Fourth. That the jail appart-
meut is entirely to small and in-
adepuate in which to keep the
county’s pnsioners.
The board having been legally
advised in the premises further
finds: That a lease of the city hall
to the connty under the terms and
conditions proposed wou'd be il-
legal and that such lease or rental
contract would be subject to an
nullment through legal proceed-
ings that might be instituted by
auy tax payer of Shawnee that
under such lease the county,s au
thority to occupy said city had
might at any time be terminated.
In further consideration of the
Board finds; That under ilie o-
piuion of Attorney General West
recently handed down upon re:
quest of Governor Haskell and
reading in part as follows: “You

be int\-rreb that the Mayor and
Councilmen of ibe City of iS.'mw -
ne representing the citizens of the
City of Shaw dee and ihe corpora
for 'he purpose of enforcing vote
rs for or against a competing
town at u county seat election;you
do not state, but it might be infer
ed that the City of Shawnee, to
gather with the City of Tecumseh
are competing towns for the
county seat of Pottawatomie
Connty, and that the statement
that the resolution is used as a cam
paign document seems clearly to
infer that the propisiton of the
gift is made for the purpose of in
fluincing voters for or against the
town of Shawnee or other compet
ing towns; you do not state, but
it might be inferred that in your
opinion and as a fact—which you
opinion is to me and mnst be for
the purpos of giving you an au
swer—that the lease of the city
hall building of the city of Shaw-
nee for the purpose named is
worth more than the sum
of ten dollars per annum for ten
years next ensuiny and that the
facts are that the gift, of a saving
of rent on the part of the tax pay
ers is meant to be made in oonsider
ation af the location of the county
seat at Shawnee. If these at* the
facts, there are in my judgement
clearly within the preview of Sec.
7 Act. 17 of the constitution o<
the state’ which section and article
of the constitution reads as follows
“iny corporation or person offer
ing money or other thing of value
either directly or indirectly for the
purpose of influincing any voter
for or against any competing town
in snch county seat election shall
be deemed guilty of bribery.”
That the giving and acceptance
of the Shawnee city hall to the
county would constitute bribery
and that the conatr commissioners
it accepting the said city hall undei
propisition made and presented
to the Board of county commis
sioners by the Mayor and conn
oilman of the city of Shawnee
offering to lease the city hall
building of the city of Shawnee to
the county for the purpose of
court rooms.county ofices aid
jail for the period of ten years
