CRUM INVESTIGATION
What is Attorney General Roberts
here for? Must Come Through
With the Townsite Money-
Judge Finlcy Probate Judge of
Kiowa Couney has been mandamus-
ed to compel him to turn all fees
from his oflice over to the County
Treasurer. If he complies it will
releive him of several thousand
dollars say fifteen. Some say that
Caddo County has more townsitcs
than has Kiowa but this is of course
irrelevant. The question is "What
significance attaches to tho visit at
this time of Attorney General
Roberts to the city. The Attorney
General lays his major premise
thusly. The fees charged by the
probate judges in the three now
counties are exorbitant outrageous
and illegal. His minor premilb is:
All fees in excess of salaries of pro-
bate judges as provided by statute
should be turned over to the County
Treasurer and held as county funds.
Now we will draw the only log.
ical conclusion. If it was illegal
(which means unlawful) for the
probate judge to take these exorbi-
tant fees it would be illegal for
them to be turned into the county
treasurer so the attorney generals
proposition is one which would
make the county a party to the
crime. If theso fees have been
collected iu violation of law let
them be turned hack to those from
whom they were taken. There are
only two ways to remove Judge
Crura. Either by the County com
missioners or tho grand jury. If
the County commissioners refuse to
act it would then be up to the grand
jury and as they do not meet until
after the next election at which
time Judge Crum would "retire it
will make iittlc or no difference
what they do about the matter.
If the County Attorney files in-
formation it will take tho case in
to the district court and would en-
title the judge to be tried by jury
and the powers that be arc afraid
tho Judge might tell something in
open court that would be embar-
esing for tho present Territorial
Republican government.
Judge Crum feels sure that the
County Court will do nothing in
the case.
Ho quotes good law to prove that
ho is trustco for tho new townsitcs
and (hat as trustee ho is only sub
ject to United States laws and not
under tho jurisdiction of territorial
law.
However these matters may bo
thero is certainly something rotten
in Denmark.
