Is to the Effect that the Governor
Has no Power to Remove With-
out Couse-
In the case of The Territory ex
rcl vs. The Board of Education et
al. an action brought to restrain
the Board of Education from locat-
ing the Southwestern Normal school
at Granite Judge B. F. Burwcll
yesterday gave judgment foi the
plaintiff.
The decision is quite lengthy. It
recites the nature of the action and
the causes leading up to it. That
without cause Gov. Jenkins had
appointed a committed to locate the
normal school without notifying a
commiitce pieviousy appointed by
Gov. Bai nes for the same purpose
except in the language of the com-
mission issued to the members of
the new committee. That the first
committee as admitted in a letter
from Gov. Jenkins to each of its
members later had been guilty of
no offense or cause sufficient under
the territoiial statutes of their re-
moval. The defendants contended that
tho right to appoint an ailicer car-
lies with it tho inherent right to rc-
movo him but while some courts
havo virtually declared this doctrine
this is not tho mlo m most of the
states. In this case tho power to
appoint was exhausted by ihe ap-
pointments made by Gov. Barnes

made no other person could legally
be appointed under any theory of
tie law until a vacancy occurred by
death resignation or removal either
by cxpices order or implication.
This theory is supported by authori'
ty. The organic- action Oklahoma
makes no provision for tho removal

nor but the legislature has taken up
mthe matter and spoken in unequivo
cal terms and where a constitution
is silent upon such matters tho
legislature has the undoubted right
and power to Bay what shall bo
auso for removing a public oflicer.
'Statutes of 1803 Sec. 5070: The
governor shall havo the power to
remove any oflicer so appointed by
him in case of incompetency neg-
lect ot duty or mancfeasanco in of-
I ficc and may then fill tho same as
provided in case of vacancy."
Over six thousand dollars were

wife told him a few things he did-
n't like ho proceeded to turn her
across his knee as it were and give
her a good punishment. She resis-
ted just as any fair minded woman
would have done and raised a howl.
The howl brought the neighbors
and they had John Stantley pinched.
John was in police court the other
morning looking "kinder funny."
His wife fallen to appear so his
honor soaked John only ten and
costs for disorderly conduct. Dr.
John lias gone no one knows
where and no one cares. Suffice to
say ho has quit the ilats and no one

N. T. Bryan one of the delegates
to the Enid convention from Hy-
dro paid this oflic3 a friendly call
yesterday evening in company with
W. W. Price of this city. Mr.
Bryan is a very progressive man
and well informed on tho political
issues that confront the people of
the Territory lie expressed him-

Authorities.
Tho protest against the final
proving up of tho Woods quarter
section by Attorneys J. A. Baker
and A. D. Roarkdidn't last as long
as a June frost when brought be-
fore tho land oflice yesterday.
Major McKnight promptly over-
ruled their protests on tho ground
that no new questions had been
brought up that had not heretofore
been passed upon.
Last fall when James Woods a.t-
tempted to prove up Attorney
Baker filed a protest against it.
Mr. Woods withdrew his applicat-
ion for final proof and Mr. Baker
undertook to havo the protest
changed into a contest but the land
office refused to allow him to do so.
Baker appealed and the appeal is
now before tho commissioner.
When Mis Woods undertoook to
make final proof Attorneys Baker
and Roark filed a new protest but
the land ofiice promptly ovei ruled
the protest.
Major McKnight in convocation
with a Democrat ropoitcr said: "I
think that tho commissioners will
uphold our decission and that in the
course of six or seven weeks Mrs.
Woods can commence selling lots."
All tho people of Lawton will be
glad to hear this as Lawton needs
room and needs it bad. Lawton

last night to attend to some legal
matters at that place.
