day morning. Not being able to
file the case-made Sunday ho
filed it Monday morning one
year and a day after day of
sentence of Gibbons. Motion to
dismiss was filed on this ground
and ovferruled under the statute
that permits a thing to bo done
tho following day when the last
day when it should be done falls
upon a legal holiday or Sunduy.
Another day and Gibbons no
matter how meritorious hia appeal
could nevor have had a hearing
in the Supreme Court. Mr.
Morgan is thoroughly convinoed
GiDbons was oonviotod on per
jury testimony and will be grant
ed a new trial. Affidavits were
filed in support of the motiun
for a new trial in which tho
witness himself ".onfeaaed to per-
jury. It was expected this wit-
nosn would be called for tho Ter-
ritory in the Reddington case in
ordor to test the truth of hia
testimony in tho Gibbona case
but the territory being- satisfied
be would not teafify ' in the Red-
dington caao aa ha had done in
the Gibbons
