The case of Bailoy vs Driskoll

this afternoon. The plaintiff
brings suit for S200 tho monoy
the defendant rocoived over his
commission in selling Bailoy's
farm. Bailey alleges that ho
listed his farm with Driskoll at
S3300 out of which defendant
una to recolvo S100 commission
that Driskoll got a buyer and
made a price of S3500 on tho
place which tho buyer waB will-
ing to pay. and that DriBkoll
bought tho farm himself and
then sold it to tho buyer for
S3500.

diction to create counties when
suoh iB necessary in formulating
tho state government but where
the creation of counties is entire-
ly unneoeBsary and where it
would havo boon juBt as well for

created then tho convention
ovor-reaohad its powers and no
suoh power was conferred upon
it by congresB and not even con-
templated. Chief Justico John H. Burford
handed down the majority opin-
ion holding the supreme court
haB no original jurisdiction in in-
junction cases. Under this de-
cision therefore tho Greer
county commissioners may file
their oaso in tho district court
hero immediately and then appeal
tj tho supremo court if necossary.
Justice Bayard P. Hainer held
absolutely that tho convention
haa power to do whatever it may
please wherein it is not repug-
nant to the enabling aot and the
federal constitution and if the
constitution iB adopted by the
people then tho constitutionality
must bo tested by the president
of the United States. Ho held
that this complaint of Greer
oounty should he filed with Presi-
dent Roosevelt.
Chief Justico Burford admitted
that tho oaso was a novelty ia
legal history.
Tho oaso was argued in the
oourt for the plaintiff by Former
Unitod States Attorney Horace
Speed and for the convention by
Delegate Henry E. Asp (repub-
lican) of Guthrio and W. A.
Ledbetter (democrat) of Ard-
