CHICK VS. STEPMOTHER
County Sheriff J. M.Thompson
having been recently admitted to
the bar was called upon by a
prominent firm of local attorneys
to render an opinion on a highly
important question. This ques-
tion and Sheriff Thompson's
opinion follows:
OPINION
CHICK VS STEPMOTHER
The following question having
been submitted to ub for our op-
inion towil:
"What relution is the hen to
the ohiokon "ho hatched but does
not lay then what relation is
there between the chioken thus
hatohed and the hen who laid the
egC?"
Wa reBneotfully submit the
following opinion and conclusions
of law towit:
It seems that all the law writ-
ton and unwritten would bo in
favor of the hen that laid the egg
aB against the hon that hatched
it.
Life and the procreation of life
are the result of nature's lawB
and not tho acoident of an arti-
ficial condition. Unless we ex-
peot tho simpler formB of life
such as protozoans microbes or
spontaneous formB of life every
animal has a mother. This
mother'o blood commingled with
tho male of the same spooies
forming a living atom. This the
mother carried through the ert-
broy period of the animal's life.
Tho bringing of this being into
lifo very naturally impresses it
with many of the appearances
and oharaoteristioB of the mother
a true test of maternity. For in-
stance a boy is born of a good
and beautiful woman. He iB
kidnapped in infanoy by one of
tho worst hags of tho Blums and
there brought up under her tute-
lage. He will retain tho looks
and oharaoteristics of hiB mother
and not of the woman who rear-
him and why? Simply because
the old hag is not his mother.
She bears the same relation to
tho boy as the hen who hatohed
tho egg does to the ohiok.
For fear wo have not eluoidat-
od sufficiently to make ourselveB
fully understood wo will go furth-
or. Suppose you take an egg
laid by a buff cochin hen and Bet
it under a Plymouth Rook; you
cot a buff ooohin chioken of
nmirnn. whv? BooaUBO the buff
ooohin ia the mother of the chick.
The buff ooohin did all that any
member of the fowl creation
oould do toward conBumating
aotual animal life when Bhe laid
the egg. in that egg a chioken
lay dorment. An incubator a
moderately heated oven a Back
of feathers or any old thing that
would have kept the egg at the
proper tomperaturo for hatching
ia as muoh entitled to be called a
mother as tho hon that hatohed
tho egg.
Frequently a hen hatcheB a
hrood of turkevB or of dudks or
perohanoe a prairie chiokon. 19
sbo their mother? We venture
to aay that neither of the mem
bers of your honorable firm
i juBtly noted as you are for the
I bold temerity of your legal opin
ions would risk your reputation
for common sense as that of
truth and voracity that she is
tho mother of this mixed brood.
"Wa have found a few oaBes in
point ono whioh we will cite :
"Casey v Finnigan 17 Ireland.
Finnigan was a bar keeper and
Casey was one of his best ous-
tomfars. Finnigan had a parrot
him four largo eggbalfivo dollars
apiece. In duo time Mr. Oasey
was much surprised believing
at first as ho afterwards testified
that tho parrot had boon associat-
ing with ducks.. Finnigan was
convicted of obtaining money
under false protonses. Is this a
oaso in point? Damfino.
V hold that the hen who laid
the ob'g is entitled to the most
consideration. Shoismoro homo
loving and domestic In short
she does more for her country
than tho setting hen. On the
other hand the sotting hon is too
improvident to lay her own egg.
Sho prefers to gad around to tho
Club and talk hen suffrage.
Her mind ia filled with vagaries.
ShethinkB she oan hatch out any
thing il sho only had the right
material to operate upon Givo
her a set of croquet bulls and she
will guarantee to hatoh out mons-
trosities like R. Z. Mcninch and
Judge Wheeler simply booauso
Mao and the Judge are croquet
fiends. Givo her the door-knob
of your law office to set upon
and she Will agree to hatch out
another member of your firm.
She is conceited enough to think
that if you would fill her nest
with a set of ivory poolballs and
a few poker ohecks that she
aould hatch you out a batch of
gold nuggetsequivolent in vaiuo
to tho money you have invested
in various parks of the world in
the aforesaid ivories.
We find the law and the fact
and incidently our sympathies
are against the sotting hen. The
best we can give her in the way
of a title is that of a step-mother.
We believe that when this de-
cision is read that all studentB
readers and writors of barn-yard
domestio relations will flap their
winga and crow Amen.
Services at Court
Tho services at tho court houso
last evening wore well attended.
Since the weather is better the
attendance is incrousing. Tho
subjeot f the sermon was "Tho
Holy Cit ." Just boforo the ser
mon Mrs. hJoaon sang tnat ooau-
tiful solo "Tho Holy City." The
sermon was tho last of a serioB of
sermon8onThoTabernacle. Mr.
Beach showed how the place in
the taboniacle oallod the Holy of
Holios waB the representation of I
heaven itself. Ho pioturod vory
vividly tho scones and Bpoke of
tho conditions imposed upon
those whoBe duty it was to sot up
tho tabernacle. He took up tho
Ark of tho Covenant and spoko
of its signification and thon gave
the meaning of tho articles wh. 'i
tho Ark cont in d. Tho sermon
was a strong und convincing one.
Mrs. Boaoh sang another solo at
tho closo of tho service. One
person wont forward and con-
fessed Christ.
