FRISCO EARTHQUAKE CASE
Husband Unable to Find Magistrate

Even the Records Lost.
Ardmorelto Special
Washington 1). C. Aug. 27. To be
called uki:i to prove one's mnrrlugo
and to bu unable to furnish tliu proof
Is a most embarrassing situation to
11ml one's self In yet that Ik pre-
cisely what has happened to a young
Kugllsh woman who applied to the
civil service commission recently for
the necessary blanks to enable her to
make formal application for a posi-
tion In the government service. It
was one of tho distressing cases
growing out of the San Frnncisco
earthquake and conflagration.
The papers which the young wo-
man filed with her application Indi-
cated that she was) born In (I real
llrltalu that she was married and
that she resided In San Francisco.
No record of her naturalization as an
American citizen was Included
among her papers and the civil Her-
ilce commission returned them to
her to supply the omission. She had
not been naturalized. In the usual
way but she ascertained on Inquiry
that the fact that she was married In
the United States and her husband
was an American naurallzed her un-
der the law.
She called the attention of tm com-
mission to this fact. While admit-
ting that her marriage to an Ameri-
can would naturallzo her tho com-
mission asked for her marriage certif-
icate. She could not find It. She
wrote to her husband In San Fran-
cisco requesting him to forward to
her cither tho original or a certified
copy of the certificate. Ho was un-
able to comply with her request. In
the flro which followed the earth-
quake In San Francisco their modest
little homo with practically all of
their belongings had been swept
away tho precious certificate being
among tho things lost.
The husband hurried to the office
of tho Magistrate who had perform-
ed the marriage ceremony. Ho found
nothing of It. The building had been
destroyed and tho ground even then
was being cleared for tho erection of
a new structure. Continued Inqui-
ries devt loped the fact that the mag-
istrate himself having lost every-
thing ho had In tho world by tho lire
had disappeared anil no possible trace
of him could bu discovered

- husband endeavored to locate the
yif "s to tho ceremony but they
too &oC '"appeared.
As a f.'j- "ort. the husband had
a careful oxi. mi made of all the
records of marriu to be found not
only In San Francisco but In the
state capltol at Sacramento In the
hope that an official report of the
marriage might be discovered. The
quest however was futile as the
marriage records of several previous
years had likewise been destroyed
and the officials had failed to report
them to the health oftlce at Sacra-
mento. Very much discouraged the little
woman here In Washington explain-
ed tho situation to the civil service
commission. She submitted to the
commission her husband's letters re-
counting tho efforts he had made to
find the required proof hoping
against hope that the members of the
commission would believe her story.
They did believe It and an order ha
been madii by the body waiving the
necessity for the llllug of the ruitil
ago certificate.
Inquiry has disclosed the fact th.it
this case while It has some unique
ft attires Is by no means the only In
stance of tho distress caused by tlie
San Francisco disaster which has
been brought to the attention of t
government. .Many Instances of tie
effect of the flro on titles to prop'rt
have been looked Into by governmeit
agents. While most of them Mtw
been adjusted the situations which
havo developed from others have
been pitiable and distressing.

There Is no doubt now that he came

came with a purpose. "The "Okla-
homa question" has I0113 been a se-
rious problem for tho national ml
ministration. It hu.l been found Im-
possible toynako tho principles ot
tho "Square. Deal' barmonlzo with
the exigencies and necessities of r
pjilillcan polltlcsc either In tho terri-
tories or the nation at largo. The
constitution had been examined nud
found to conform to the provisions of
tho enabling act and was lu no way
In conflict with the constitution of
tho I'lilted States.
Something heroic had to bo doi.e
to keep Oklahoma with her seven
electoral votes out of tho union un-
til after the next election at least.
Some radical measures must bo taken
to save the hundreds of fat Jobs lu
the territories to tho carpet baggers
from Illinois Kansas Indiana and
other states F.vorythlng pointed to
the plain conclusion that tho new
state under present conditions a!
least would be hopelessly democratic
The long years of vicious bureau
cratlo misrule and Ugh-hatid-d offl
clat outrages by administration ami
department pets and parasites had
driven the people to revolt mid lei'
tho republican party to a bhamefii
defeat lu choosing delegates to th
constitutional convention and the
craven hearted leaders responsible
for the condition that brought thli
about wero Importuning tho presl
dent cabinet members and tho vie
lous old spoilsmen of the Joe Cauuoi
type for help for some 0110 to save
them from (he democratic avalaiicnr
that threatened to adopt the constitu-
tion and wipe tho last stain of cat-
pct bag rule and department despotism
from tho map of the two territories
And then It was decided to Bend
Taft he of tho expansive smile and
pltithoHc paunch to tell theso rebel
1 1ons subjects that .they nun. vote
down the constitution: he dldu't ap-
prove of all of Its provisions nud
whllo Koosevelt night be compelled
under the enabling act tj Issue the
proclamation yet that did not make
tho document satisfactory to in cor-
titrations and to Mr. Tn't. He lold
them also that If they w-ro deter-
mined to ratify the conrtl'iithm then
they should certainly elect Governor
Frantz and a republican legislature.
It Is very good of this republican
ambassador to tell the Oklahoma pen
pie all this but he did more. He
told us what would happen If we vot-
ed the constitution down Ho mad"
this promise and thcreh) ex pose-1
the Infamous republican conspiracy
to butcher up tho Indian Territory
like a conquered province and par
eel It out piecemeal to Oklahoma
whenever by colonization of negroc
or by tile corruption and debauch
ery of Its peoplo any part ot It could
bo made ready to add political
strength to tho rotten republican bor-
(.ugh they deslro to make out of 01-
lahoma. Ho did not say this lu quite
IhlB plain language but ho covered
It this way speaking of tho coustitu
Hon:
"I think therefore that tho condi-
tion should bo rejected. I don't thlnK
It possible to amend It In such n
way as to correct Its defects; I:
needs complete revision. I wouldn't
do It because I should bo confident
that there should bo .1 now enabling
act If you reject this constitution
that there probably would bo an or-
ganization of tho organized territory
of Indian Territory until you could
got ready for Joint statehood nnd
that when you would pass lu with
a constitution made up by persons
who nro not so patriotic ami not m
full of the deslro to exactly ascer-
tain the will of tho people."
So that is tho plan? To defen' the
constitution ami statehood In order
that wo may go back to tho old "piece
meal absorption" plan so Ingenious-
ly figured out by Dentils Flynn and
steadily urged by Mc(!u:'.? Cade
Seay and other wheel horses lu tho
Oklahoma republican machine
Tho other suggestion whether hon
"stly meant or not would bn very
apt t oprovo only too probable If we
wero to get a now enabling net.
With their present experlcnro the
republicans would never pass an en
aiding act that permitted tho peoplo
of those two territories an opportU'
nlty to write a constitution that con
talned a patriotic purposo to protect
tho people or one that was not die
tatcd by tho bureaucrats and special
Interests whose welfare Mr Taft
seems to hnve so much at heart.
