the interior to enforce the collec-
tion of (ribal taxes imposed upon
merchants engaged in business in
the Choctaw and Chickasaw na
(ions with the assistance ( federal
troops if necessary will be defin.

days. The whole subject will be
treated exhaustively in a decision
hfllnded down by Attorney Gener-
f ail "Griggs.
Although the opinion reached at
the department of justice is being
: careiuuv guarded it is learned on
reliable authority that the attorney
general will hold that the secre-
tary of the interior is empowered
with authority to use federal troops
for the ejectment of intruders or
offenders against the law on the
publio domain or lands fafld in
"inrBtlfof'the"benefit.;-df the Indian
tribes. As the secretary of the in-
terior is clothed with authority to
use federal troops for the ject-
meet of intruders or undesirable
settlers on Indian reservations it
therefore follows that he has equal
pow-er and authority to eject mer
chants in the Choctaw and Chick
tteaw nations who refuse to comply
with the laws governing tfcose
countries.
It is pointed out that the tribal
governments have certain rights
guaranteed to them by -treaty
agreements with the United States
and that one ot the provisions of
the treaty of 1897 ratified byeon.
grees providing for the allotment
in severalty of the lands of the na-
tions guaranteed to the Indian
tribes the right to maintain their
own form of government for a per-
iod of eight years and to levy and
collect such taxes as they might
deem proper. This authority hav-
ing been delegated to them by the
congress of the United States and
the nations having availed them
selves of this privilege by the en. j
actment of certain laws lor the
raising of revenue to support the
tribal governments it is clearly
within the authority of the secre
tary of the interior to either force
the collection of these taxes from
the merchants or to eject them
from the Indian reservations.

It is further pointed out that the
secretary of the interior is the
guardian of the Choctaw and
Chiclftgow Indians being the ex-
ecutive officer of the government
immediately in charge of their af-
fairs; and that if it becomes ne-
cessary for him to uee force in or-
der to protect the rights of the In-
dians he has ample authority to
do so.
There is some apprehension felt
at the department of the interior
over the rituatioo in the Chicca-
giw nation
of the failure of the agents of the
department to fully ndvise the
authorities here as to exactly what
steps have been taken. The jo
eition of the department is that
they have no authority to attach
the goods of the merchants in the
Choctaw and Chickasaw nations
and to dispose of them fordelin
quent taxes. The authority of the
department ceases when the delin
quent merchants are ejected and
their merchandise and effects re

these attachments were levied for
the purpoHe ot merely closing up
these joercantile establishments
or with the object in view of die-
posing of the goods to meet delin
quent taxes the department is not
informed. If it was the former
the agents were acting strictly
within their legal rights and in
accordance with instructions from
the department. If the object was
to sell the goods to pay the taxes
due the tribes then the agents
probably exceeded their authority
and may bave laid themselves li
able to damage suite. As the
agents1 of the department were
estopped lrom final action by a
temporary restraining orders from
the courts it is probable that they
have not overstepped the instruct
ions of the department.'
TOWNBITE SUBTESTS.
In response to a large number
of requests rceived from citizen
of smaller towns in the Indian
Territory 'who desire to take ad-
vantage of the provisions contain
ed in the Indian appropriation bill
past last winter permitting them
to survey their own towns with
the approval of the secretary of
the interior the department is
now preparing general rules and
regulations covering this subject.
The exterior limits will be sur
veyed by government engineers
and it is probable that several ad
ditional surveying parties will be
put in the field for this purpose
shortly. The. applications thus
far received have been referred to
Special' Agent George Wright at
Muskogee for investigation and
report. It is expected he will re-
port on a number of them within a
few days. Lithographic maps of
Muskogee have been prepared by
the department and are now on
sale at -50c each.
