T!ie session of the Cherokee National Council at Tah-
lequah which convened last Monday Is an exceedingly
tame affair. With no political patronage to distribute
the members are loth to attend and a quorum has been
lacking.
Up to Wednesday afternoon absoiutly nothing had
been done by the Cherokee Council. Chief Rogers read
a short message to the assembled members Sunday after-
noon dealing In general with the disposition of tribal
property undisposed of by the Cherokee agreement.
The campaign against swearing that is being inaugu-
rated in many sections of the country should be promoted
la Yinita. Swearing Is not as respectable as it used to
be and each year sees less and less of profanity. There
are one or two places in Vinita where oaths may be heard
most any time one is passing. Ladies never enter these
places but such awful profanity and vulgarity should not
be allowed even in a place where women never enter. A
loud mouth swearer is a great nuisance and ought to be
dealt with.
For an indicator as to how much the delegates to the
Muskogee convention believe in a fret speech and a free
ballot the citizens should investigate the form laid down
for conducting the constitutional election. If a citizen
votes against the constitution he is denied the privilege
of voting for the candidates to be voted for at the same
election. If this is not "bulldozing" the voters what Is?
And where is the free ballet guaranteed the American
citizen ? Probably the gentlemen In control of that con-
vention believe that they are not yet citizens of the

GEOWTn OF COMMON SCHOOLS.
Herbert Spencer strongly opposed the public school
system as part of "the coming slavery which he con-
ceived to be store for people who allowed the government
to do anything outside of police work. Yet the millions
of children who are now educated at public expense tes-
tify to the inefficacy of his plea. But academic as his
argument seems today there was a time not so very long
ago when it would have received general approval. In
spite of the favorable beginnings in colonial New Eng-
land the common school system did nut become preva-
lent throughout the United States until about seventy
years ago.
It was the intellectual impulse of the renaissance and
reformation that lad to the first great development of
common schools in England. Curiously enough tins
spread of learning is indicated by the increasing number
of convicted felons who escaped the gallows by pleading
"benefit of clergy." In Medevial England it was assumed
that if a man could read he must be a clergyman and so
not liable to the penalties of ciil courts. Even after
the abolition of the criminal jurisdiction of the ecclesi
astical tribunals the convicted felon could "call for the
book" read the neck verse and go free with merely a
Tyburn "T" branded on his thumb. This anomaly was
not abolished In Virginia until near the beginning of the
nineteenth century.
The records of Middlesex county England show that
in the reign of Edward V only eight and one-seventh per
cent of convicted felons "read like a clerk." In Eliza-
beth's time the percentage had risen to thirty-one and
under James I nearly forty per cent of the felons called
for the book. Thus it happened that the first American
emegrants came from the country which was taking
pains to educate its children.
To the general interest in education the Puritan set
tlers added a strong i religious motive. A Connecticut
statute of 1672 has this to say of schools :
"It being one chief Project of Satan to keep men from
the knowledge of the Scriptures as in former times keep-
ing them In an unknown Tongue so in these latter times
by perswading them from the use of Tongues so that at
least the true sense and meaning of the Original might
be clouded with false Glosses of Saints seeming deceivers;
and that Learning might not be buried in the Graves of
our forefathers in the Church Colony the Lord assisting
our endeavors; It Is therefore ordered by this court."
The statute goes on to provide lor instruction in
reading and writing in every town with fifty or more
householders the teachers to be paid either by the par
ents of the attendant children or out of the general
funds. A similar act had been passed by Massachusetts
in 1646. The Dutch colonists were equally solicitous
about their children's education as were also the Vir
ginia settlers; but the plantation ife in the South pre
vented the development of a public school system until
comparatively late. Throughout the country however
schools continued to be elementary and to be in many
cases supported by pupils' parents until the second third
of the last century when the efforts of norace Mann
effected great improvements. But it was not until after
the Civil War that the present system of graded instruc-
tion was perfected. Today more than eleven million
children In the United States receive daily instruction
in the common schools from a half million teachers.
