A Resolution relating to the Improve
ment of the following portion of the
Streets and Avenues of the City of
Vinita Craig County State of Okla-
homa to-wit: .All of Illinois Avenue
from the East line of Thompson
Street to the East line of Foreman
Street; and providing for making
said Improvement under and pur
suant to the Provisions of the Act
of the Legislative Assembly of the
State of Oklahoma approved the 17th
day of April 1908 entitled :"An Act
to Provide for the Improvement of
Streets and Other Public Places
Within Cities of the First Class by
Grading Paving Macadamizing
Curbing Guttering and Draining the
Same and Declaring an Emergency."
Whereas the City of Vinita Craig
County State of Oklahoma is a city
of the first class of the State of Okla-
homa and
Whereas it has been ascertained by
the Mayor and City Council of the
City of Vinita that it Is and is hereby
declared necessary and that the public
convenience requires that the follow-
ing portions of the streets and avenues
in the City of Vinita should be
Improved by grading curbing gut-
tering and draining the same
and constructing thereon a vitri
fied brick block pavement with cement
filler to-wit: All of Illinois Avenue
from the east line of Thompson Street
to the east line of Foreman Street
and that the property abutting on the
parts of the street and avenues afore-
said will he especially benefitted by
said improvements.
Mayor and Councilmen of the City of
Now therefore be it resolved by the
Vinita Oklahoma;
Section 1. That it is hereby declar-
ed necessary and that the public con-
venience requires that the above de-
fined portion of the streets and aven-
granitoid the curb portion being six
inches thick and fourteen Inches high
and the gutter shall be two feet wide
and six inches thick except at alley
crossings where the gutter shall be
four feet wide and feix inches thick.
That the curb lines on the above de-
fined portion of said Illinois avenue be
and the same are hereby established
on each side thereof a distance of 25
feet from the property line on that
portion of said avenue between Thomp-
son Street and Foreman Street.
Section 2. T'aat when this reso-
lution shall have been published for
six consecutive Issues in the Daily
Chieftain a newspaper of bona fide
general daily circulation In the City
of Vinita Oklahoma if the owners of
more than one-half in area of the prop-
erty liable to assessment to pay for
the above described improvements as
herein set. forth shall not file with
the City Clerk of the City of Vinita
their protest in writing against such
improvements within fifteen days from
the date of the last publication; then
the Mayor and City Council of the
City of Vinita Oklahoma shall cause
the improvement provided for in this
resolution to be made and the cost of
such grading .paving curbing gutter-
ues in the City of Vinita Oklahoma
be Improved by grading paving curb-
ing guttering and draining the same
as follows to-wit:
That it Is hereby declared necessary
and the public convenience requires
that the above defined portion of Illi-
nois Avenue from the east line of
Thompson Street to the east line of
Foreman Street be so improved by
grading the same and reducing said
avenue. r '"
Said avenue above defined to a sub'
grade sufficient to permit of the con
struction thereon of a concrete base
course 5 lncnes in tnicKness upon wis
shall be laid a sand cushion of 2 Inches
in thickness and upon this be laid a
single course of vitrified brick block
with cement filler on all that portion
of said avenue lying between the
granitoid gutters on each side thereof
hereinafter provided for a width forty-
six feet from the east line of Thomp-
son street to the east line of Fore-
man street except at street and alley
crossings where the paving shall ex-
tend across the full width of the
street which is one hundred feet ex
cept that portion taken by granitoid
gutters across alleys; that there shall
be constructed on said avenue a com-
bined curb and gutter constructed of
Ing and draining shall be paid by spe-'
clal assessment against the abutting
property to the center of the block
where the abutting way is on the ex-
terior of the block and to the exter-
ior of the block where the abutting
way or the improvements are made
on an alley or other public way on the
interior of such block and each quar-
ter block shall be charged with its
due proportion of the cost of so Im-
proving the areas formed by alley
crossings;
Provided that the cost of construct
ing the improvements provided for in
this resolution shall be apportioned
against the abutting property in the
manher provided for above according
to the benefits to be assessed to each
lot or parcel of land.
Section 3. That after the expiration
of the time for protest or objection to
the improvements provided for herein
if no sufficient protest be filed the
Mayor and City Council shall there-
upon adopt a resolution expressing the
determination of the City Council to
proceed with the above described work
of improvement and which said reso-
lution shall define in detail the extent
character and width of the improve-
ment the material to be used the
manner of construction and such other
matters' as shall be necessary to pro-
vide for the proper and intelligible ex-
ecution of the above defined work of
improvement. i ...
Section 4. That when the Mayor and
City Council shall have ascertained
the benefits to be assessed against
each particular lot and parcel of land
for the cost of said improvements to-
gether with all expenses incident
thereto they shall embody the same
in an ordinance charging each lot and
parcel with its proper share of the
cost of making the above described
Improvements. Thereafter it shall be
lawful for any property owner affected
thereby to pay the full amount thereof
to the City Treasurer and receive a
certificate discharging his . property
therefrom within thirty days from the
date of the passage of such ordinances
The assessments against the..tybut
ting property to pay for the cost of
constructing the above described imr
provements as apportioned corrected
and confirmed by the City Council
shall be payable in ten equal annual;
installments and shall bear interest
at the rate of seven per .cent per
annum until paid payable each jear at
such time as the several Installments
of the assessment are made payable
each year.
Provided however that in case said
assessment and interest is not paid
when due the assessment so accrued
and unpaid shall bear interest at the
rate of eighteen per cent per annum
until paid.
Section 5. For the reason that pub-
lic necessity demands the immediate
construction of the above described
work of improvement an emei senev;
is hereby declared to exist by reason
whereof it is Immediately .' riecesaarff
for the preservation of the public
peace health and safety that this or-
dinance shall be In full force and ef-
fect from and after its passage ap-
proval and publication and It is so
ordered.
Passed by the City Council of the
City of Vinita Oklahoma on the 7th
day of June 1910.

You are hereby notified that the City
Council of the City of Vinita Okla-
homa will receive sealed bids for the
construction of a sanitary sewer run-
ning East and West through Block 42
and running North and South throiiMU
Blocks 21 and 23 in the City of Vinita
Oklahoma. ..
Ail bids shall be accompanied by a
certified check for $50.00 to guarantee
that the bidder if successful will make
and enter Into a contract and give
such bond for the performance of such
work as may be required by the City
Council.
Bids for such work shall be based up
on the plans and specifications for the
same on file in the office of . the en-

NOTICE IS HEREBY GIVEN that
sealed bids will be received by the
City Council on the 21st day of June
1910 for the improvement of South
Gunter street from the curb line on
the north side of Delaware avenue to
the cur'u line on the south side of Illi-
nois avenue by grading curbing gut-
tering and draining the same in ac
cordance with the plans and specifica
tions on file in the office of the City
Engineer.
Bids- must be made on blanks furn-
ished by the City of Vinita.
Bids must be accompanied by a cer-
tified check in the sum of Two. Hun
dred and Fifty dollars to guarantee
that the bidder if successful will make
a contract and furnish bond satisfac
tory to said City within fifteen days
from the acceptance of his bid.
The basis of estimating the lowest
bid will be the qualities set forth in
the engineer's estimate.
All bids will be opened in public
council at eight o'clock on the 21st
day of June 1910.
The right to reject any bid or any
part of any and all bids is reserved by
the City of Vinita.
All bids must be filed with the City
Clerk of the City of Vinita at or before
six o'clock p. m. on the 21st day of
June 1910.
The party to whom the contract may
be let shall execute to the City a good
and sufficient bond in the amount of
fifty per cent of nls proposed contract
price conditioned for the full and
faithful execution of the work and the
performance of his contract and for
the protection of the city and all prop-
erty owners interested against any
loss or damage by reason of negligence
or improper execution of the work and
said contractor shall be required to
give a bond in amount of twenty-five
per cent of his proposed contract price
for the maintenance in good condition
of the curb and gutter work for a per-
iod of five years from the time of Its
completion
Separate bids shall be received for
the work of grading and draining said
avenue and for the work of construct-
ing the curb and gutter thereon.
