established at Oklahoma City in the
county of Oklahoma in the said state.
But this section 6hall be construed to
mcn that the capitol of the state may
be located on the land selectfd for the
capitol jurposes by the state capitol
commission hereinafter created either
within Oklahoma City or not to eiceed
five miles therefrom.
Section I. A commission to be
known as the state capitol commis-
sion is hereby crested. Said commis-
sion shall be composed of three quali-
fied electors to be appointed by the
governor within thirty days after
the approval of this art but no more
than two of them shall te of the same
political party. Each of the members
of said commission shall subscribe to
the Path required by law of tie other
state officers and shall execute bond
t be approved by the governor in the
sum of fifty thousand dollars condi-
tioned for the faithful performance of
(the duties imposed upon them by law
and each of them shall be paid a sal
ary of four thousand dollars per an
mam. The term of oSce of said com-
missioners shall be two years but they
shall be subject to removal by the
governor at all times and said com-
mission shall terminate at the expira-
tion of two years from and after the
first day of March. 1911 unless it shall
be continued by act of the legislature.
Section 5. As soon as practical af
ter their appointment and Qualifica
tion they shall orgraniie by electing
one cf their cumber chmrman. A ma
jority of the members shall constitute
a Quorum to do business and perform
the duties and exercise the powers
conferred on tie commission. Said
commission Csl.; have the power to
sue or be sued ar.d to defend or be

jpowers or duties. Said commission

cate the state capitol. and shall have
power to tuske all necessary contracts

contracts and agreements for the con-
struction of the capitol but no such
contract shall be binding on the state
until approved by the legislature.
It shall be the duty of the governor
to transmit the report of Eaid commis-
sion and any contract it may have
made for the construction of the cap-
itol to the legislature as soon as prac-
ticable. The capitol shall be constructed of
granite marble or other material quar-
ried or manufactured within the state
of Oklahoma provided the same can
be secured at a price not to exceed
the cost of suitable material of like
kind from without the state.
Sectiou T. There is hereby appro
priated out of said state capitol fund
the sum of one million five hundred
thousand dollars to be used for the
erection of stale capitol buildings and
one hundred and fiftv thousand dol-
ars for furniture equipments and
ground improvements and forty thou
sand dollars for expenses of the state
capitol commission including salaries
and indioental expenses and ten thou-
sand dollars to defray the expenses of
every character that may be incurred
in moving the state offices and the pa-
pers records and property belonging
to the state of Oklahoma from Guthrie
to Oklahoma City.
The money hereby appropriated out
of said state capital fund shall be
drawn from the office of the commis
sion on warrants approved by the gov
ernor.
Section S. All laws in conflict with
the provisions of this act are herebv
repealed.
Section 9. An emergency is hereby
declared to exist for the immediate
preservation of the public peace and
safety by reason whereof this act shall
be in force and effect from and after
its passage and approval.
