Washington D. C Fob. 12. Demo-
crats and Hepubllcans In the house
committee on territories have practic-
ally reached an agreement regarding
the admission of Oklahoma and In-
dian territory to Joint statehood. They
differ regarding New Moxlco and Ari-
zona and as a result two reports will
lie m-jde. The majority ruport. If the
present plan. Is carried out will favor
the admission of Oklahoma an-1 Indian
territory as one state nnd of New
Mexico and Arizona as one sta'e. The
minority report will make one state
of Indian terrltorj and Oklahoma and
provide for ihe admission of New Mex-
ico as a state with Its present bound-
aries. Arlsona Is to be admitted ac-
cording: to minority report at such
time as a census shows it will have
sufficient population to give it a rep-
n sentatlve Jn congress under the
congressional apportionment.

law Invalid. T:a case of a
white man who married a Choctaw
woman according to law complying
with article 38 of the Choctaw treaty
ctf 1866 In which the wife It was
charged deserted the husand who aft-
er two years filed suit for divorce and
whose wife died efore the culmina-
tion of the divorce proceedings la one
on which the decision is ased The
man afterward married a white wo-
man and the Choctaws claimed that
under the law passed y the Choctaw
council in 1S75 the man lost his citi-
zenship rights because he "married
out" of the Choctaw tribe The treaty
of 1866 placed citizenship require-
ments on the basis that a white man
should marry a Choctaw or Chickasaw
Indian by blood and reside in one of
the two nations. The white man In
question having compiled with the
treaty became a el'isen of the Choc-
taw nation and a member
of the
triue entitled to share In ail dlstrlbu-1
tlons of land and monoy belonging to J
the tribe. j
The court holls that no law passed
af er the treaty was made conflicting
with the terms of the treaty could1
abrogate any part of It. therefore the j
white man Is still a citlsen of the

ant Charles Woods held to the opin
ion lately announced by the attorney
general Mr. Simons which was that
even If the taxes for the first half of
he year should be delinquent an I un-
paid on tho third Monday in January
1001 for example the taxes due June
15 would not become delinquent till
the third Monday In January 1902.
Compliance with the opinion of the
attorney general will make If possible
for the peculiar condition to arise that
property may be sold for taxes due In
two separate years the lat half of the
one year and the first half of the next
the tax sales taking place in Novem-
ber. Again there win be the differ-
ence that taxes for the first half of
the year will become delinquent in
one month after they are due while
the last half will not become ellu-
quent till seven mouths ai -r they are
due. Before the enactment of (he
present law taxes became due In one
annual payment and a taxpayer was
liable only once a year to have his
property sold for taxes Now be
