May Be Turned Over to Territorial
Treasurer by the Board.
At the request of Governor Fergu-
son Attorney General Strang has
prepared a written opinion concerning
the vexed question of tho custodian-
ship of school land rental monoys and
tho opinion Is to tho effect that the
control of tho" rontal money is In tho
hands of tho school land board sub-
jout to tho ultimate action of tho soo-
rotary of the interior. Tho opinion is
addrossed to Governor Ferguson and
reads In part:
"In compllunco with your roquost
for tho opinion of this offico as to
whether tho board for leasing school
lands may turn tho money received by
said board out of tho leasing of said
'and to tho territorial treasurer. I
havo to say that by act of congress
npproved May 4 1804 the leasing of
all school lands and of sections 13 and
33 In each township being respectively
for the unlvorslty agricultural col-
logos and normal schools and for pub-
lic buildings was placed In the hands
of a board consisting of tho govornor
socrotary and superintendent of public
Instruction of tho torrltory of Okla-
homa that in mv Judgment this powor
to lease carries with it tho control of
the funds dorlvod from tho leasing of
said lauds subjoct at all times as a
mnttor of course until wo get state-
hood to tho ultimate action of tho
secrotary of tho Interior which is pro-
vided for by certain rules and regula-
tions by him.
"I have examined these rulos and
regulations and I find nothing thoroln
incoriBlstont with tho powor of tho
board to turn such monoys ovor to tho
treasurer of tho territory except and
unless It bo found In the last para-
graph of rulo four."

dlrtctu that all funds received from

be deposited In some bank designated
by the board In the name of the
board. .
"It mutt be understood that rule-
four is not an act of congress." the
attorney genoral says in his opinion
"but Is merely an instruction formulat-
ed by the Intorior dopartnlent for tho
leasing of the school lamia and tn
disposition of the proceeds arising
therefrom and that any mollification
by Uie board for leasing school lands
which better protects the fundi aris-
ing from Uie leasing of such luntls
falls to receive the approval and rati
flcatlun of the Interior department
These funds when turned over to in
treasurer will be deposited by him In
the territorial depository as a special
fund to be held by him subject to the
order of Uie board for leasing of
school lands and whenever such foods
are to be distributed the secretary
of Uie board ran draw orders which
ahull be signed by himself and coun-
tersigned by the chairman of the
board on the territorial treasurer for
the disbursement of said find in ac-
cordance with the distribution made
by said board."
