that occurred at the oponlng of tho
Cherokee Btrlp for settlement on Sep-
tember 10 1803 cropped out In an
opinion handed down by tho Kansas
City couit of appcalb. Mrs. Rebecca
Freeman and Mrs. Carrlo Smith en-
gaged I. N. Club of Marshall to drive
them Into the torrltory locate land
aud get their registry numbers at the
Hnld land ofllco. Club was to furnifah
a fast team of mules a new wagon a
cowboy driver arid later .to solid lu a
wagon load of provisions. Instead he
sold his interest in tho matter to A. L.
West who wus not a cowboy but a
stranger and who showed up on tho day
of tho race with a wind-blown team of
mules a rattle-trap of a vchlclo and an
iuspiring confidence lu his o-vn ability
to find a good claim. In the heat of
tho race the mules wero passed by
everything that walked crawled or
Hew and along In tho afternoon the
wagon broke down. West unhitched
the mules and leaving the women
with tho coyotes for companions tried
to find his way back to Kansas. He
got lost. Lata tho next afternoon
however ho showed up with food and
a new wagon and located the women
on a claim. Tho land suited them all
right but they rofusod to pay on the
ground that the contrast had not bean
kept fully.
West sued and got judgment In a
justice court which judgment was set
aside by the circuit court and yestor-
day the court of appeals sot aside tho
ludgment of the olreutt court holding
that whllo the wbolo contract had nut
boon kept the fact that West had
loeaUd them on a claim that suited
them was sufilcient ground to hold
the contract performed. The amount
