Judiciary committee held a session
yesterday on the Jadge Rieks case.
The two reports were presented and
read and after a lontr discussion the
committee decided by a vote of 7 to 5
to reopen the case to extend an invi
tation to Judge Iticks to appear be-
fore them if he so desired with his
witnesses and to give a like invitation
to the other side.
This action was taken on motion of
Mr. Harrison of Alrbama. who re-
frained from votiog at the last meet-
ing. The affirmative rotes were cast
by Messrs. Hay of New York Power
of Ve mont Iiroderick of Kansas
t'Ddeirratr. of Iowa. Childs of I i la.
nois Itepublicans; (ioodnight of Ken
tucky anu Harrison 01 Aiaoaina Demo-
crats. The negative votes were cast
by Messrs. llailey of Texas Iiontncr
of Ionisiana Lnne of Hlinols.Stockdalc
of Mississippi and DeArmond of Mis-
souri Democrats. Representative
Culberson chairman who voted for
impeachment at the last meeting re-
frained from voting.
The members who have stood with
Mr. liailey for impeachment regard
the vote as a practical defeat so far
as action by this congress is con-

Wasiiinotov Jan. 10. Representa-
tive Itailey submitted to tliB judiciary
cointnittee of the house the re-
port prepared by him In explanation
of the proposed impeachment of
Judtre Ricks. It first recites tho
charges ngninst tho judge and says
tho evidence establishes the following
pertinent facts: A. J. Ricks became
clork of the circuit court for the
Northern district of Ohio March 20
1S73 and served until July 21 1S30
when he became the district judge.
During the time that he was
clerk there was pending in
the circuit court n large
number of cases brought by John C.
Rirdsull and the llirdsnll Manufactur-
ing company against various defend-
ants involving a question of patent
infringements. The moneys out of
which he is charged with having de-
frauded the government are the fees
for makintr final records in fifty-five
of these cases which were not finally
disposed of until after he had be-
come tho judge of the district court.
His defense for this conduct wai
that as he was clerk when tho decrees
was outered in the cases ho was en-
titled to make the final record
nnd in his emolument rpports for the
first half of Itws the last half of 1SS3
and tho first half of IsSO ho charjrod
himself with a part of these fees. The
report says that under soction 813 ' of
the revised statutes each year stands
by itself and the clerk has no better
right to nnticipnto fees which inny bo
earned in n subsequent year than he
would hnve to recover a part of the
excess which had been earned in a
previous year. The purpose and tho
only possible purpose in picking out
those cases und anticipating their
fues was to incroase his personal com-
pensation and in doing that he was
not only violating the law but ho was
practicing a deliberate and wilful
fraud as will easily be seen by a sim-
ple calculation.
Mr. Iiroderick of Kansas submitted
the minority report on tho case.
It is not shown by the evidence tho
report doclares nor is there any pre-
tense that Judge Ricks while clerk
over retained or attempted to retain
more than his maximum compen-
sation S3 500 per annum.
'I view of all the facts in this
case" the roports concludes "it is
our conclusion that Judgo Ric'.cs Is
not guilty of nny oironse that thoro
was no intention of wrong doings and
that no moral turpitude' attaches.
We therefore recommend that the
resolution reported to tho house for
iinpeaohmont be not adopted."
