Case if Dismissed.
Judge T. 1J. Moore dismissed the
case against Jimnile liansome a negro
charged with criminal assault this
morning on the grounds that suffici-
ent evidence had not been filed for a
preliminary hearing.
M. B. A. Attend Funeral.
Members of the M. 11 A. lodge are
requested to meet at the hall tomorrow
afternoon at -:30 o'clock for the pur-
pose of making arrangements for the
funeral of Mrs. Mary Scroggin. The
members of the order will attend the
funeral iu a body.
Operation for Appendicitis.
Pete DeVore underwent a surgical
operation at the Chickasha hospital
yesterday for appendicitis and was re-
ported today as getting along nicely.
Mr. DeVore came in from Jlobart for
medical attention. lie has been suf
fering with attacks of the disease for
several months.
Penquites Return.
Mrs. Walter Penquite and children
Robert and Lillian returned home last
night from their summers camping
trip in the mountains of Colorado and
Arizona. Dr. Penquite is expected
home with the camping outfit in a
few days. The Penquites have been
spending the summer camping for the
benefit of Mrs. Penquites health
whic h Is greatly improved.
Freight Agent Arrives.
K. M. Higgins traveling freight agent
for the. Rock Island rail road has been
transferred to Chickasha where he
will make his headquarters and his
family moved here yesterlay. They
will be at home at 706 South Fifth
street. Mr. Higgins will make Chick-
sha his headquarters. He moved here
from Oklahoma City.

WOOTTEN WERE WINNERS
C. i1. Witherspoon won the single
in the tennis tournament held at 13th
and Dakota avenue yesterday after-
noon and Dick Wool ten and Joe Bur-
ney won the double entry.
The game was not called until 2
o'clock in the afternoon on account of
the rain in the morning. Most of the
tennis players of the city took part
iu the game and enjoyed the afternoon.

Convicted of Larceny.
L. L. Pinkerton charged twice with
being drunk and once with petty lar
ceny was before Judge H. L. Grigs.
zy in police court this morning. Ho
was convicted on all charges and was
given a fine of $50 and CO days on the
county reads. ' Pinkerton was accused
of robbing a man of $13 Sunday morn
ing in the Sam Cook place. The mon-
ey was found on his person and he was
convicted of the charge. Roth men
had been drinking and conflicting
stories were told. Pinkerton alleged
that the money was given him to be
held In trust.
City Attorney INmmerly and Maur-
ice Smith were the attorneys in the
case.
C. Ireton convicted on the charge of
being drunk was placed on the street
today to work out a fine of $1!. Jack
Harris a vag was fined $10 and a wo-
man by the name of Reanor was fined
for fighting and immoral conduct.

Kreemort Wis. Sept. ". Four per-
sons were killed and 40 injured when
a Soo line train left the rails near
Freemont. A misplaced switch was
the cause.
It was the limited passenger train
with steel equipment. Some of the
injured are in a serious condition.
WILL BE BROTHER'S BEST MAN.
Tom lioyd will leave tomorrow for
Ardmore where he will spend a week
and serve as best man at the wedding
of his brother Lou1 H. Boyd which
occurs September 11!. The bride-to-be
is Miss Inez Stewart one of Ard-
more's most popular young ladies.
Loula Boyd has been postmaster for a
number of years and is recognized as
one of Ardmore's best citizens.
