A REPUBLICAN DEFENDSyTUE CONSTITUTION
3. II. Franklin a Lawton republican writing in the Oklahoma Post
(republican) criticizes Jake Hamon severely for the insolent reply made
to President Murray's request to make.'.known the objections to the eon-
ttitution and he defends the constitution in part as follows:
"The truth is that barring the gerrymander there is no serious solid
v:til objection to a single provision contained in the constitution; and the
truth is furthermore that the reason these gentlemen Tefused to give
Murray's proposition candid attention is because they are "unable to go be-
fore the committee of the constitutional convention and present a single
taction worthy of consideration. The constitution as a whole is an ad
mirable organic law. Upon investigation it will be found that there is-no
merit in the criticiams that have been made 'by the anti-statehood press
(notably the State Capital) and politicians. Many false representations
have emanated from these sources ani-it is palpable that there has been
a systematic effort on the part of this faction to mislead and prejudice the
minds of republicans by unfair methods. Let us advert to some of the so-
called objections which have been most !trenuouly urged:
"It has been charged that Section j5 Article VI providing that "The
returns of every election for all elective state officers shall be transmitted
by the returning officers to the secretary of state directed to the speaker of
the hou.se of representatives who shalPbpen and publish the same in the
pnsence of a majority of each branch of the legislature" etc. is an attempt
io C-oebelize the election laws of the new state; whereas that section was
pied almost literally from the constitution of Illionois of 1870; and the
constitution of Iowa contains a similar provision; and the only substantial
difference between the Oklahoma constitution relating to the returns of
the Wtion of president and -vice present is that the returns under the
latter are transmitted to the president of the senate. f
"Exceptions are taken to the initiative and referendum; and it .is
averted that the incorporation of this" feature in our constitution is ob-
noxious to the provision in the enabling act and the federal constitution
which requires that the state government shall be "republican in form.'
.'r vcrthtlcs: the republican UU of "Oregon adopted this innovation in
1002 and the supreme court of; that' state has declared it to be consti-
tutional; and moreover the people of jOregon without regard to political
affiliation proclaim the measure .to beboth wise and beneficent. The fact
J that the initiative and referendum is a "big -stick" in the hands of the
people; one which no legislature may defy and no corporation render inef-
fective. No man will fear it unless U wishes to perpetrate or perpetuate
some wrong unless he wishes to foist on the people some measure in-
imical to their interests or retain some law on the statute book which has
proven to be prejudicial to the public. Weal.
"Other objections of minor importance have been made against cer-
tain provisions of the Constitution; but when such are impartially consider-
ed and compared with like provisions in the constitutions and laws of otlier
states it will be seen that the criticisms are either frivolous or exaggerat-
ed or are altogether without foundation.
"It may not be strictly true as Mr. Bryan asserted that the Okla-
homa constitution is the best ever written but it may be truthfully
eaid that it is an organic law under which the popl of all parties maj
enjoy the legitimate fruits of their .toil and the liberty vouchsafed to
to American citizens. And furthermore it will be ratified at .the polls
by a majority of all ihe voters of all parties in h two
in my humble judgment when the .constitution and the election returns
ore transmitted to President Roosevelt that intrepid patriot and statesman
will issue his proclamation declaring to the world that the state of -Oklahoma
is and of a right ought to be "admitted into .the union on an equal
footing with the original states."' ' l"-""V
