Chickasha Oklahoma to pay Its pro
portionate part of the cob! of the con-

Whereas the mayor and council of
he city of Chlckisha Oklahoma did

District No. 6 of the city of Chickasha
Oklahoma and ordered the construc
tion of hiteml district sewers there-
n In accordance with un act of the
eglsluture of the territory of Oklaho
ma entitled "An act authorizing mu-
nicipal corporations to extend or build
general Hewer systems and to levy spe-
cial assessments of taxes to pay for
the same" approved on the 16th day of
March 19()3 and extended In force In
the state of Oklahoma by the consti-
tution thereof and did on the 5ih day
of October 19n8. contract Hh T. W.
Roberts of Independence Missouri for
the construction thereof In accordance
ith the plans speclfk.nions profile
and sections theretofore prepared
therefor by the city engineer and ap
proved by this body and
Whereas the city engineer has filed
his certificate and report with this body
certifying that the said lateral district
sewer has teen completed by the said
contractor In accordance with the said
contract and stating that the cost
thereof under the terms of the said
contract including all other expenses
Incurred ty the city In addition to the
contract price is 11603.19 and show
ing the proportionate part chargeable
to e.3ch lot and piece of ground there
in in the proportion that each lot
and piece of ground bears to the area
of the whole district exclusive of the
public highways. In accordance with
the said act of tie legislature of the
territory of Oklahoma .above referred
to under the head of "Proportionate
Part of Cost." which said certificate
and report Is hereby referred to and
made a part hereof as fully as if writ
ten out herein .?nd
Whereas the said cost of the said
sewer as certified by the said engl
neer Is less than the estimated cost
thereof heretofore filed by the said
engineer and approved by this body
Be it ordained by the mayor and
councllmen of the city of Chlckash.?
Section 1. That there is hereby !ev
led and assessed against each of the
lots and pieces of ground in said Sewe
District No. 6 the certain sum shown
by the certificate of said engineer to
be chargeable to the said lot or piece
of ground as Its proportionate part of
the cost of the construction of the la
eral district sewer in said sewr dis
trlct and hereafter set opposite said
lot or piece of ground under the till
marked "Proportionate Part of Cost.'
Paid tax and assessment abov
provided for shall be levied and
collected In three equal . an
nail Installments with interest
thereon at the rate of eight per cent
per annum beginning thirty days after
the passage and approval of this ordi
nance and there shall be levied and
collected each year the installment of
said assessment due th.it year and the
Interest upon all unpaid installments.
The first installment thereof with In-
terest upon the entire assessment shall
be due and payable upon the fifteenth
day of December 190!) and the bal
ance of said installments with inter-
est upon all unpaid installments shall
be due nml payable upon the fifteenth
day of December of each year there
after until the entire assessment Is
That the sld installments of said
assessments In case of entire assess
ment shall not be paid off and dis-
charged within thirty days from and
! after the first publication of this ordi
nance for each of atd years shall be
extended upon the tax rolls for said

same manner and by the same officers

Proportionate nl If at the expiration of said time
the amount assessed against each of
the aald lota and pieces of ground shall
not be paid for then the mayor and
council shall cause tax warrants
to be Issued against each of the said
lots and pieces of ground; which said
tax warrant nball recite the dale of
the passage of this ordinance the
amount of the assessment and the de-
scription o( the property and shall
be signed by the mayor and counter-
sinned by the city clerk and shall be
delivered to the contractor In payment
of the contract price of said work.
Section 4. That it Is necessary for
the peace and safety of paid city that
this ordinance shall be operative at
once in that its raiiure so to act would
cause great Inconvenience and hard
ship upon the city and the said con
tractor accordingly .an emergency is
hereby declared by reason whereof
this ordinance shall be In full force
and effect from and after Its passage
approval and publication.
This ordinance duly passed with sec.
tlon four considered separately and
passed by the affirmative vote of
three-fourths of the members elected
to the council on this the 2tst day
of January 1909.
