Lawyers havo experienced no little
dlfllculty In appreciating that Ilrltton
SL Germain and others of our earliest
legal writers spoke udvlscdly when
they defined a freehold Interest In land
(which boru to our early law the rela-
tion occupied in modern law by tho
word ownership) ns meaning the "p.rs-
session of tho soil." Yet the accuracy
of this definition at the date of Us
origin finds the most ample and varied
attestation in ou authentic legal his-
tory. Tho word "owner" was unknown
to our early land law. That one who
wrongfully dispossessed nnpthcr of hs
land succeeded to the estate or inter-
est in tho land was one of the must
deeply-rooted doctrines of tho common
law from the time when the Idea of
an estate In lands was first con-
ceived. Tho dlsposscssor acquired that
which he could sell and transfer and
th.it which upon his death would de-
scend to his heirs. On tho other hand
tho person dispossessed had nothing
left which any one could buy or which
in the event of his death his heirs could
Inherit. It was almost tho middle of
tho present century before in Englund
this ceased to be the law. The natural
cITect of this doctrine as the reader
will no doubt bo prepared to believe

one of tho most interesting and prolific
branches of our earlier jurisprudence.

trap for a fox the other day In a clear-

had been broken on and fox tracks led
