This record was kept up until tho con-
testants were formally taken In by n

showed that thu Diinsmoro house ac-
cepted the precedents laid down In tho
books as correct.
Much was said about the Heed house
the court ucnl on in support of tho
prnctlro ot counting in tm-mbers but
the lteed house had one of Its own rules
formally adopted upon which to bnso
tho speaker's ruling. The Diinsmoro
house hud adopted no such rule. Moro
than five persons who were counted In
by tho Dunsmoro house had never rec-
ognized it ns such but wcro carrying
on a house of their own. Speaker ICccd
never counted In any jiersons who had
not recognized him ns speaker. Now
lliuro could be no question that tho
Douglass house was organized by tho
votes of sixty-four members who held
certificates.

that there were some Irregularities In
the organization of the Douglass liouso
because It did not receive tho roll of
membership from the secretary of state

that the court could not Interfere in
the controversy between tho rival
bodies but the supreme court could not

a jurisdiction than to assume n

it It was claimed that the Douglass
liouso was destroyed whon the senate
and governor recognized the DtuiKinoro
house. If that was the law the gov-
ernor and senate two years ago might
hnvu destroyed the populist house nnd
created a republican house. And tiro

be overturned to accomplish partisan
ends. If the Douglcxs house had vol-
ntarlly dissolved w hen tho governor
and senate recognized tho rirnl body
tho question of du facto government
would hnvo been a strong force In tho
case but it did not dissolve and it was
still In existence.

justlco Incidentally Indorsed the opin-
ion of Judge Ilazen in tho injunction
caso against Slate Treasurer lliddtc.
In conclusion the chief justice said
tho Douglass hous was the lawful
house of representative and In Ids
views on the subject he announced that
