presents for tho consideration of
tho executivo of tho Chorokco na-
tion tho propriety of requesting
this dopartment to require all per-
sons resident in the nation hold-
ing pimafitcir certificates of citizen
tdiip to present their claims heforo
tho commission provided for by
the act of council of December Sth
ISSli within tho time prescribed
by paid net and whether it would
not bo an act of justice to revoke
nil certificates issued to parties
unless thoy shall comply with the
provisions of said net. Mr. Wyly
fetibinits these suggestions fur tho
reasons bo any thero is nn evi-
dent intention notably manifested
by a iccont publication of ono W.
J. Watts advising parties to ab-
stain from presenting their claims
before -mid commission.

the recommendations therein con-
tained and requests the issuance of
tho necessary orders by this de-
partment with tho remark that
"such parlies (claimants tocilizcn-
ship) linvo presumed to rely upon
iho' indifference or foiinffaiicc of
the genernl government to enable
them to protect llioir rcsidenco in
tho country indolfinitely ns per-
sons l.iolding prima fncic certifi-
cates." Ynu stato in your lotlor lor-

think it would be injurious to the
country that the Chorokcos should
be allowed to feel by failure to
take notion in thoso mutters that
thoro wag any "indiflbrenco or con-
nivance" as suggested by Mr.
Itushvliend'H letter.
Upon this subject I dodie
to tay that this department
hns over been willing and
ready to adopt some menus for
tho settlement of this vexed ques-
tion honornblo nnd just alike to
the claimants nnd tho Cherokee
nation. It is a fact homo out by
the records of this office that every
rcnsonnblo effort has been inado by
this department to induce tho
Chcrokces to adopt some measure
with that end in view. I nivsnlf
have given the subject through in-
j vestignlion nnd iimc'i consid-
eration. I have been nftlio opin-
ion nm jiow nnd so stated in my
1 report to tho sccrotnry of tho in
terior on tno 'Jutl ol June l.SSti
that tho proper and most fair way
to. determine this question was tho
establishment of n Miutnision to
consist of two porsoii" ono to he
appointed by tho secretary of the
interior and one by tho principal
chief of the Chcrokces tho unani-
mous decision of tho commission
to be final and in case of disagree-
ment they to appoint a third tho
deciion of a majority to be final.
No doubt thero aro many per-
sons claiming citizenship in tho
uneroKco nation who iiavo no
rights nnd who perhaps aro auaiu
of that fact but there aro at least
some honest claimants. These
'people have all been allowed to re
main nnd innko improvements intho
Cherokee country for the renson
solely Hint tho Cherokee authori-
ties would consent to no rcnsonnblo
fair and just plan of determining
their rights and status.
This department has manifested
no "indifl'ercnco" or"counivunco"
in this matter of which fact no ono
is better informed than Chief
llushyhcad mid ho should be more
careful in the choice of his lang-
uage mi communications of an of-
ficial nature.
I hnvo taken n firm stand upon
ono point in this matter and it
mnkes no diirerenro whether or
not it bo termed by tho Chcrokces
"iudilleronco or connivance" and
that is this: I will not knowingly
be n party to nny act which will re-
sult in depriving these claimants
to Cherokee citizenship of ono del-
lar's worth of property.
I stated in my report to tho de-
partment dated March L'.'id 18.S7
that: "As tho Cherokee nation
"has seen fit to tako the delormiu-
"ntion of tho churns into its own
"hands I do not see thnt nny nc-
"tion is necessary on tho part of
"Hie department except to inform
"tho Chorokco authorities that it
"will determine for itself whether
"or not nny person hIiuII bo re.
"moved as an intruder nnd it will
"not pormit nny person to bu de-
prived of his improvements with-
"out a fnir ctuisidcrntion for tho
"snmo." Tho department concur-
red in theso views by letter dated
.March 25th 1887.
