been murdered. That a man with as
liltlo thought of danger should fall by

still tho shock was nono the lighter
and expressions of rcgrot wcro general.
From an eyo witness wo secured tho
following particulars of tho tragedy: A
horso raco run that day had brought a
number of hard characters to town and
whisky was flowing pretty freely in
fact Muskogt-0 was In its glory. Cnpt.
Blxkiiler had been sick for somo tlmo
and was In a sCnso off duty and at tho
tlmo unarmed. Just alter dark ho was
going down tho main street when two
persons called to him. Turning around
ho mot his falo cowardly and cruel as
it was. In tho neighborhood of a
dozen shots wcro fired hut ono In tbo
face and two In the body did tho work.
Yates tho tinner in front of whoso
shop tho killing took place was tho
flrbt to reach tho dying man and It Is
Intimated that. to him tho assassins'
names wcro given oro lilo departed.
Whether this is tho caso or not tlicro
seems no question but that tho men
wcro Dick Yarn and Alf Cunningham
both Cherokccs and brotuers-in-law.
After somo delay tho body was dressed
and then convoyed homo and on
Sunday was buried. Immediately
after tho killing tho two men ran to
whero their horses woro hitched one of
them exclaiming "Hurry up they will
bo right after us." In this presump-
tion thoy were at fault for It Is roported
that to all appearances they might
havo stayod in town as no ono dated
say a word and pursuit was never
thought of. Bbelly Keys tho marshal
changed hat and coat that ho might
conceal his identity and looked as
though ho would llko to coutract for a
cast iron suit o( clothes.
Capt. Sixklllcr was moro widely
known than any officer In tho territory
and has for years been tho head and
front of tho Indian polico force. Not
directing his men in difficult and dan
gerous situations but leading them.
That moro than one evil doer should
havo fallen at his hand was not to bo
expected. Ono of tlio most notorious
of tills character was Dick Glass a
desperoto outlaw for years and who
was killed somo two years ago. Tho
cause of enmity of Vann and Cunning
ham was partly owing to a case of this
kind tho victim being Jess Nicholson.
This man was wounded in the heel last
summer from tho effects of which ho
died though it is not known who shot
him ns Capt. Blxkiiler Charley Lafloro
and possibly others were firing. Somo
hours beforo the shooting of Blxkiiler
Cunningham's honor had received a
set-back at tho hands of Tom Kcnnard
a Creek negro lighthorse who had
beaten him over the head with n six-
shooter. This raised a clamor for
blood and possibly had much to do
with the tragedy that followed.
Venn it will bo remembered was
sentenced to tho penitentiary for thrco
years a few months ago for an assault
upon Capt. Hamar at Fort Gibson
but was pardoned by tho president.
Wo aro informed that United States
writs have been issued for tho men
named and placed in tho hands of an
odiccr. Tho prediction is that they
will not bo served without a fight. As
all tho parties were Cherokecs It seems
as though tbo tnattor would como be-
foro tho Indian courts (perhaps Hie
Creek whero tho otlcnco was commit-
ted) for trial unless tho fact that tho
murdered man was a United States
deputy marshal cuts a figure In the
caso.
As soon as Itho news of tho murder
reached this town word was sent to
Luko Sixklllcr a brother of tho de-
ceased and ho went down at onco.
Henry wo understand is now in
California.

no Indian should bo allowed to visit

hold that even tbo red man has a per-
fect right to go whoro and when he

However from all accounts wo judge
It would bo much hotter for tho Indian
to give Seneca a very wide berth on ail
occasions. ""
A Serious Accidmt. Mr7Sam Skin-
ner met with a very painful ami serious
accident last Bundav ovcnln. which
will mako him an invalid for rnanyV
day. He was driving his spirited
horso and whllo turning the corner
near L W. Bufllngton's stablo the
buggy was overturned. Mr. Skinner
landed upon his feet and with such
forco as to produce a compound fracture
and dislocation of tho ankle joint tbo
bones of the leg protruding through the
flesh. Tho fracturo was slight only a
very few small plocos being chlppod ofi
tho end of tho bono but novcrtholoss
tho wound is a serious ono indeed.
Medical attention was secured without
dolay and within a short time the
bones wero roturuod to their places
and properly bandagod. What was
surprising was that in apito of tho
shock aud accompanying pain Mr.
