GOVERNMENT GRANTED APPEAL
Order Made Allowing Reherin In
Commodity Clause Case
1 PHILADELPHIA: Judges Dallas
Cray and Ruffington of the United
States circuit court handed down an
' order allowing the government to ap-
peal from the decision of the court in
! the suit of the United States in the
1 matter of the constitutionality of the
"commodity clause" of tho Hepburn
rate bill.
Counsel for both the government
and the defendant coal roads will pe-
tition the supreme court of the
United States to give this case pre-
cedence over all others on account
of its great Importance.
The assignment of errors upon
which the appeal was allowed are
about ten in number and were filed
by Ii. Allison Wilmer special assist-
ant to Attorney General Bonaparte
' and by District Attorney J. Whittaker
Thompson.
It is contended that the circuit
court erred in holding that the clause
is not a valid exercise of the powers
of congress under the constitution
and that the measure would deprive
the railroads of their property with-
out due process of law.
It is also contended that the court
was wrong in declaring the law dis-
criminative and a prohibition and
not regulative of interstate commerce.
BIDS FOR FLYING MACHINES
Navy Department Wants Four Capa-
ble of Making Flying Start
WASHINGTON: Aerial navigation
as an auxiliary to the naval service
is contemplated in specifications for
four flying machines for which pro-
posals for construction will be asked.
Tho specifications require (hat each
machine shall rarry two persons of
a combined weight of 350 pounds a
sufficient supply of fuH at the start
for a night of at least 200 miles for
a period of four hours at an average
speed of not less than forty miles an
hour and to remain continuously in
the air during the trial.
They arc to be so constructed as
to be able to alight without damage
on land or wafer to float on the lat-
ter when at rest without wetting
any of the air supporting or controll-
ing areas and to he able to rise there-
from without appreciable delay under
their own power without the aid of
special starting apparatus.
Hidders must guarantee the deliv-
ery at the naval academy at Annapo-
lis of at least one machine within five
months after the signing of the con-
tract and tho remaining three within
eight months.
