The annual report of the Interstate
f'dmmeree Commission Just issued
has the following paragraph about
trespass:
"The commission desires to call the
attention of Congress to the matter of
trespass on railways. Figures com-
-plled from the monthly reports of ac
cidents resulting from the operation of
steam (ailways In the. United States
nr shown in a table in the report
from which It appears that 5000 tres-
pasurs were killed during the year
ended .Tune ISO 1M0. This number is
mure than 50 pur cent of the total
number of persons killed in railway
nee id en Is of all classes resulting from
the operation of trains locomotives
ami ears during tho year and it repre-
sents a loss of lifn for which laxity In
the enforcement of the Inns seems to
be largely responsible. Of the tres-
passers killed only 23 per cent were on
trains Of the 77 per cent not on trains
a large proportion were trespassing on
the right of utiy OS!) being struck or
run over by locomotivfs or ears at
stations or in jnrds 83 at highway
grade crossings and U.oRl at other
places along thu tracks. Thu commis-
sion's Investigations of accidents dis-
close instances in which it is morally
certain that serious accidents to trains
have been caused by malicious acta of
trespassers. While 1U states have leg-
islated upon the subject of trespassing
it at pears to be ditlloult to secure the
entnrcemunt of such laws and car
riers thus fail to obtain the protection.
In this regard which the public wel-
fare demands. The commission be-
lieves that thu matter is of niflicisnt
importance to warrant a consideration
of thu advisability of enacting a Fed-
eral statute prohibiting under appro-
priate penalty trespassers on the
trains tit interstate carriets and on
the trACks of such carriers at places
where there are two or more tracks
or within the limits of incorporated
towns or at places where the carrier
by apprepriate sign or warning gives
nutlce that trespassing on Ids tracks is
prohibited. Any such statute should
however provide that nothing therein
is Intended to make lawful any tres-
pass which would bn unlawfuj under
state laws. It might be that Congress
could confer concurrent Jurisdiction
upon Federal and state courts for the
enforcement of any statute which
might be enacted upon the subject"
