the criminal court of appeals is to be
continued.

ed for its continuance.. The present
justices were all appointed and will

UnJer tho Koss bill the number of

present namely three. They are to
have the same qualiiieatlons ru judges
of tho supreme court and their sal-
ary Is to be $4.nO0 a year. Vn.tor. the
present law It is only $3500. At the
general election o? 1910 three judges
are to be electt'l for a term of six
years. They i.ro to draw fo' terms.
One will draw a term of two years
one four and one term of fix years
Alter IftlO t.-ey arc to be cl"ctd for
tems of six years each one oi them
every two-years. . - . "
The conn Is to have jurisdiction
over such criminal appeals as would
otherwise go to the supreme court
but constitutional questions will coe-

diction of the latter body. Kaeh jus-
tice Is to have a law clerk at S 1 200

shal of the supreme court ar to per-
form the same offices for the criminal
conn'.
McCslla Fiflhts Increase.
McCt.Ha offered an amendment pro-
viding that tae compensation should
remain ai at present provided. He was
not much in favor of continuing the
court as he believed that by 1911
the ruprenie cou.'t woulj hive caught
up with its work. He did not like
tae idea of making provisions which
were to extend beyond the legisla-
ture that is to sit. two years hence
and b -lievt i t'jr.t by I hat time the
necessity for this branch of the Judi-

was particularly opposed to the in-

would only pile up matters for aa al-

Judge Cool lid not desire to see
the criminal c rutt continued but
would rather i.viea..c the numoer of
supreme court justices to eight.
JlcCalle briefly replied along his
revious line of argument; Tillotsou
followed 1'iid s. -owed reasons for the
contlnuatloa of the'et urt an' the In-
crease of salary. He did not believe
.good men coulM be tempted to leave
their law praei.ee and go fln the bench
far less than $4.o00.
RoSs staled the McCalla amend-
ment would kill tne bill to which the
latter tool; exception
McCulU's amendment provided that
the judges should receive the same
compensation as at present provided.
Cn a vote his amendment carried.
Then he moved to reconsider and
table. This carried too and it was
'hen pointed out that the present
statute would be dei.! as a hammer in
.January 1911. The legislature would
then have other matters on hand and
there would be a court with no al-
ary provided for.
McCalla Amendment Lost
McCalla changed his previous amend
ment to real that we salary should
be J3T.00. This was lost thw"! fixing
the salary at $4000.-
King desire to cut the salary of
the law clerks from $1200 to $1000
but this amendment was tabled.
Jahn sent up a substitute for the
entire bill under which the criminal
court n.i to be abolished and five
additional justices of the supreme
court were to be elected In 1910.
Thereafter tie number of Justices
was' to be ten. This amendment was
also lost and the bill was then adopt-
ei an. I ordered to engrossment.
Join Ruler. Adopted.
Mcniny the cotnmittee on joint
rules reported and report wss adopt
