Dlspoaln of Civil Business l Still At-
tracting the Attention of the Court.

Chiekasha I. T. Oct. 11 In
the United States court todav the
jury in the case of Bohart vs. Craggs
returned a verdict in favor of the
plaintiff.
The case of Ira Seeds vs. D. Ap-
plegate was called for trial and re-
sulted in a verdict for' the plaintiff
for $350 and $100 damages for de-
tention of the property. This was
a replevin suit.
The case of Libby Johnson vs.
Dr. J H. Strum was next called.
This case has attracted consider-
able attention. Dr. Strum lives
near Chiekasha and he and S. C.
Hudson a brother of the plaintiff
originally swore out a complaint
against the plaintiff for adulter
and fornication with one Jerry
Miller. Upon a hearing before the
commissioner the complaint was
dismissed and Mrs. Johnson the
defendant in that complaint
brought this suit against Dr. Strum
for malicious prosecution alleging
damages in the sum of $15000.

homa and the Indian Territory will
arrive at Ardmore Saturday p.m.

Chiekasha he will go to Sherman
Tex.- prior to his return here.
Mr. and Mrs. W. B. Pyeatt have
returned to Ardmore for the win-
ter. The . hotel at Sulphur which
has attained such enviable popul-
arity under their able management
has been closed for the season.

Was it Robbery or
Deputy McLemore who went af-
ter the 'lone highwayman" men-
tioned in yesterday's Akdmokeite
returned last evening with a man
whom he held for identification.
The man did not size up exactly
to the description given by the
party claiming to be robbed and as
no one appeared to prosecute the
suspect he was turned loose. Dep-
uty McLemore is inclined to think
the countryman who said he was
robbed is mistaken at least as to
the method of robbery. Mae is an
officer with a whole lot of experi-
ence and is not easily eaught nap-
ping but he some how thinks the
man lost his incnev "some wav"
and the robbery report was a win-
dy. Another turn in this ease has ar
rived today. It seems that a mer-
chant of Orinne held a mortgage
on the cotton which the victim of
the robber- old yesterday to
Weiss Bros. The' Orinne mer-
chant is here investigating the
matter today.
Lost A Puppy.
Reward will be paid for the ic-
turn -of a liver and white" pointer

Death at Tishomingo.
Among the telephone news re-
ceived today we find the sad tid-
ings of the death of Miss Ella Har-
ris davgher of ex-governor If.
M. Harris whirh occurred at U.-.'IO
o'clock yesterday afternoon at the
Harris residence near Tishomingo.
The legislature which was in
session when informed of the cir-
cumstance at once framed resolu-
tions of regret and expressions of
condolence to the bereaved family
and adjourned their session until
after the burial of deceased.

Are We a Favored People?
These railroad people have some
very peculiar ideas about territory
people. In fact we are looked
upon as being millionaires with
dead oodles of scads. Just to
show you. The people from Texas
are allowed a rate of $1.60 Gaines-
ville to Ardmore and return' to
see Ringling Bros. show. A little
over a week ago an effort was
made to get reduced rates Ard-
more to Gainesville for a number!
of our people to attend a funeral
in the latter place. Rates were
quoted $2 for round trip and so
many must go to make that re
duction possible. We could refer
to the past summer excursions $1
and return from Cleburne to the
Canon and link that with the
Confederate reunion occasion.
Then a colored excurt was sent
out from Gainesville to Ardmore
SO cents for round trip. No white
trash in the territory ever bad
such inducements. Yet we are
rich independent and don't care
but one of these fine mornings
will witness the territory people
buying some new railroad then
"look out Liza."

cil of Sainesville for their mayor
is $400 per annum and the Hes-
perian says it is time for the $400
candidates to hang out their flag.
North Texas papers while not
crediting the rumor ssy that the
Dallas fair will close one week
earlier than contemplated on ac-
count of a shortage of water.

More Juvenile Race War.
While Edna the little daughter
of Dr. and Mrs. W. T. Gardner
who attends the Danlap public
school was on her way home yes-
terday in company with another
little classmate they were obliged
to wait at the railroad crossing in
the north part of town until a
freight train had moved out. :In
the mean time a little colored girl
came np and fearlessly walked up
to the moving train. Child like
little Edna cried out that she
might get hurt by getting too close
to the train. The little darky at
once gave vent to her feelings by
using some of the grossest vile
language which she could frame
and wound up by telling her if she
was alone she would just beat her
to death and threatened to do so
the first time she found her by her-
self. Mayor Gardner was not in
good humor when seen today and
informed us that he intended in;
vestigatiug the matter at once as
the practice of black children as-
saulting and insulting white chil-
dren could not be tolerated in Ard-
more if he could help it and he
thought he could.
At the Jail.
Deputy J. B. Davis of Colbert is
here today. He brought in two
prisoners who were committed by
Judge Hardy at Tishomingo. They
are Henry Rogers larceny and
Will Barber introducing.
Burge Bryant a joint keeper at
Ada was brought here this morn-
ing and placed in jail by Deputy
Nestor under commitment from
Judge Winn's court on a charge
of csianlt to kill. Burge has been
here before in the same capacity
and is not unknown" to our officials.
Cob Baxter furnished bond and
was given his liberty today.
Frank Pettitt is reported quite
sick with fever.
Police Court.
Police Judge Gait heard a tale of
woe this morning from Will Gino
and wife who were charged with
fighting. They each entered a
plea of guilty and were fined $6.65
each.
The gambler's cases were taktn
up this afternoon.
An Italian Fad.
Bear fighting by the high aris-
tocracy is one of the latest fads re-
ported from Italy. The prince of
Malfetta recently gave an exhibi-
tion in which he himself fought a
young bear which had been trained
not to use its claws for scratching.

Commissioner's Court.
A suit on attachment for rent
was tried in commissioner's court
yesterday between A. F. Van Horn
and John Eli. W. U. Savage was
party to the suit as interpleader.
Van Horn a native leased the land
on which the crop is growing to
Savage aud EH was a tenant under
Savage. The trial was by a jury
which decided that the lease had
not expired and that the rents be-
longed to Savavge. All the parties
are from Mannsville.
Another attachment suit between
A. J. Powell and Bill Huckaby
both of Earl was tried by a jury
in Judge Bradford's court today.
Plaintiff asked judgment tor $26
and was given a verdict for the full
amount.
A similar suit was tried yester-
day between Mrs. Mollie Price and
her tenaut occupying the Mill farm
near Lone Grove. Plaintiff was
given judgment.
The city council of Gainesville
has elected Judge II. S. Holman
city recorder and ordered an elec-
tion for the office of mayor to be.
held on Tnesday Oct. 24.
Burglars at Davis..
According to the '.clepLone news
from Davis this afternoon some
parties np there must be short on
pants. Hotels and resident houses
seemed to have shared alike from
the account given in the telephone'

than one person was implicated in
the robberies which ocenred in
four different ibices there last
night.
