the appraisement of lota in Ard-
more upon which there are per-
manent substantial and valuable
improvements other than fences
tillage and temporary honses that
no such appraisement will be made
by the commission on any lots
upon which buildings are erected
or bnilt after January 25 1000;

here plaintiff brings suit for a cer-
tain tract of. land consisting of
about 320 acres lying one-fourth
mile southeast of the town of
Grantham and known as rhe
Bromelow and Sickles place.

against one A. B. Harris for a cer-
tain tract of land in the south part
of the town of Ardmore contain-
ing about 40 acres and known as
the "Douglas field."

Of the Killing of Ernest Truelove as
Told by a Newspaper.
In addition to what 'was known
of the killing of Ernest Truelove
in Gainesville and which was
given in the Ardmoreite yester-
day tbemost interesting version of
the sad affair is told by George
Russell the defendant to the re-
porter of the Register and is as
follows.
"The killing was not intentional
it was purely accidental: Ernest
Truelove and 1 have always been
the best of friends. Ernest was
deeply under the influence of li-
quor when he came into my place;
after being there a few minutes he
took out his pistol and shoved it
into the face of our negro porter
in a playful way and demanded of
the porter to repeat the words "I
am a nigger." Soon after this oc-
currence Ernest put up his gun
and then went to the stove when
he commenced to create a most of-
fensive nuisance. I walked from
behind the bar and went to the
stove where he stood and took hold
of him and told him to go with me
to the back way and not to do as
he was doing .a the stove. I spoke
to him in the best of humor and
was aiming to help him to the back
door for he was very drunk by this
time.
Soon as I took hold of him to
lead him away he attempted to
draw his pistol getting his hand
on the weapon. I saw what was
coming and I threw my arms
around him to prevent his drawing
the gun and iu the scuffle which
followed he got it out of his pocket
and let it fall to the floor. Both
of us attempted to pick it up tad
I finally succeeded in getting hold
of it and upon raising up it went
off. I had no idea of shooting
Ernest at the time nor did I in-
tentionally point the weapon to
ward him. I am sure the weapon
was cocked when I picked it up
for I never cocked it nor once
thought of shooting Ernest for he
and I have always been good
friends and all I intended doing at
the time was to keep him from get-
ingholdof his gun fori felt certain
that he would shoot me if he did
get hold of it being drunk like 1 a
was for he seemed to have lost all
reason whatever. We did not
quarrel no angry words passed
between us. I'm sure the pistol
was cocked when it fell to the
floor and Ernest must have put it
into his pocket cocked when he
had it out after the negro porter
or he mav have cocked it when he
attempted to draw it on me. How
ever this may be I never intended
to shoot him no such thought
ever entered my mind and when
the weapon went off no one was as
much surprised at the report as
was.
Had I been looking for trouble
with Ernest it is very evident
would have taken the pistol from
behind the bar with me when
went out to ask him to desist from
doing as he was at the stove."

A Business Block Barned to
Oround" The Loss Is Heavy.
About 11:15 o'clock last night
the fire fiend visited' Dougherty
and wrought serious havoc in one
business block of that growing
little town.
The first intimation of fire was
discovered by Jeff Moritz who was
asleep in the store room of his
brother Marone Moritz ; the dense
rolling smoke had almost stiffled
him and reaching for his trousers
he ran to the outside.
The hot air in the room and the
density of the smoke kept any one
from re-entering the building.
In a brief space of time flames
burst forth all oyer the building
and it was plainly seen that every-
thing within the walls was deomed.
The building was a one story
stone affair and was divided by
wooden partitions thus three sep-
erate store rooms.
The sufferers are Marone'Moritz
who carried a general merchandise
stock of about $7000. on which he
had $3000 insurance with the Red-
field agency at this place. Mr.
Moritz may have some other in
surance but the writer could learn
of no other at this place.
The next room was occupied by
M. D. Chitwood with a stock of
groceries valued rrom $WJU lo
$800. " Insured "to the amount of
$400 in the Redfield agency.
The third room was the furni
ture store of Charles Garrison.
Loss and insurance unknown.
The building was the property
of Ben Bechtel and W. J. Wil
liams who estimate their damage
at about $1500. No insurance
that we could learn of.

A General Conglomeration of Busi-

Ed Christian a' motion for a new
trial was overruled.
In the replevin case of Caroline
Ayers vs.R. S. Bell the jury was
discharged the case transferred to
the equity docket and referred to
to master in chancery.
D. A. and T. II. Todd dis-
charged as bankrupts.
In the case of D. II. Courtney
an order of allowance for minors
was granted.
Mary Ellis vs. Choctaw nation
substituted record filed-
The case of Nelson vs. Nelson
was dismissed at cost of plaintiff.
United States vs. Jerry Riddle
et al forfeiture set aside as to
Riddle and sureties A. J Wolver-
ton and W. R. Riddle.
W. A. Ledbetter receiver vs.
Ed Vaughn et al judgment to
record ordered.
Motions for new trials were filed
in the following cases:
J. W. Orchard et al. Sarah
James et al. G. V. Alexander et
al. J. H. Cornish et al. all
against the Chickasaw Nation.

Prominent Stockman Dead.
J. T. Jamison died on Monday
the 15th at Pontotoc of abcess in
his ear. He was raised in Tar-
rant county Texas where he has
many kinfolks and acquaintances.
Mr. Jamison has always engaged
in the cattle trade and was in
possession of a large ranch and a
thousand bead of cattle near
Pontotoc.
He was an untiring worker
honorable and exceedingly gener-
ous. He leaves two sons to mourn the
death of a father in the very prime

as local treasurer of your branch
which is accepted by us so far as
we are concerned. '
We would like that the share
holders of your town get together
and appoint some one else. It
makes no difference to us whom
they appoint a&Jqral treasurer just
so they are satisfied. All other
officers or directors of the local
branch are simply the representa-
tives of the shareholders of that
branch. - Dues may be sent "at ill
times direct to the home office.
We advise the election 'of local
treasurer ' simply for the conven-
ience of the shareholders saving
them the trouble of going to the
post office or express office and se-
curing a money order or risking
their funds in regular letters. But
they may do as they like and we
have today written every share
holder fn Ardmore stating that you
had resigned and that they had
better get together and appoint an-
other colieetor as may suit their
convenience providing that you
are not willing to continue. ' '
You may retain the literature
until they have gotten together
and made such an appointment as
suits them at which time you may
hand it to that party who may be
able to receive some subscriptions
for shares from time to time as
we are certainly interested in get-
ting a good business started in
Ardmore and certainly regret the
unnecessary expense incurred upon
that branch as well as other share
holders of the company on account
of Mr. Rudisill as it must be borne
iu mind that any expense of this
character comes right out of the
pockets of your next door neigh--bor
who is holding shares iu the
company.
Share holders must not bear ma-
ice to the officers of the company.
He does that individual no harm

force is suffering with the grippe
and obliged to stay in his room.
The commissary crew from Mr.
Valliant's camp west from here
where they are running a survey
for the Arkansas & Choctaw were
here today and loaded up some $75
worth of groceries.

The Morris Sass stock of mer
chandise is claimed to be damaged
about 50 per centj. and we learn is
covered by insurance.
The outbreak of the fire is de
scribed by Jeff Moritz who is in
the city as follows:
"When I was awakened by the
smoke which came rolling down-
ward from the ceiling in great
rolls I called to Chitwood iu the
next room where the same con-
dition of affaiis existed. Chitwood
and myself reached the street about
the same time and we lost all our
clothing except our pants.
The fire originated between the
ceiling and the roof and the entire
top of the building seemed to be
burning but it was a few minutes
before we could see the blaze then
it burst forth "all over the place.
The gases from the asphaltum
and tar roof seemed to have pene-
trated the adjoining building occu-
pied by Morris Sass for with a
roar it tore the ceiling of his store
room to pieces -and burst the doors
from theirhinges; glasa was thrown
across the street by the terrible ex-
plosion. The origin of the fire is
wholly unknown.
