themselves. Some may take up the
notion tbat if you ratify tbe agree-
ment that you adopt the negro no
greater mistake could be made. .To
ratify the agreement will do no such
thing. Think what do you ratify?
Simply an amendment to the agree-
ment to authorize the allotting
agents when they go to allot to give
the negro 40 acres to keep and bold
uati his legal right to it can be set-
tled that is all. The Curtis law does
the very same thing arid the negro
gets no more than he has now he
has possession of it now and con
gress only intends for him to hold it
until they provide him a remedy to
settle it. In fact at one time that
was understood that congress would
give the Chickasaw freedmen tbe
right to bring suit in the United
States' court of claims against the
Chickasaw Nation to determine bis
right to the 40 acres of land under
the treaty of 1886. The senate really
passed a bill for tbat purpose and it
went to tbe bouse and was favorably
reported back to the bouse by the
Indian committee of tbe bouse to
whom it was referred. So don't be
uneasy on that account. Again un-
der the agreement if ratified no ne
gro or Indian can get a title to bis
or her allotment only by tbe joint
conveyance of the executives of tbe
Choctaw and Chickasaw Nations 1
don't think they would make tbe
negro a deed until bis right to tbe
40 acres of land was legally decided
for bim. And sbonld they attempt
such a tbiug any Chickasaw citizen
can bring suit in tbe United States
court and enjoin them or any one
else from conveying the land to the
negro upon the ground tbat tbe land
is tbe property of tbe Chickasaw In
dians and not that of the negro this
"would bring up the whole question
as to whether or not the negro owned
the land and the court would be
'compelled to decide'; that question
from the law and the evidence when
the court did decide either party-
could appeal to the higher court
there is no danger in that whether
you ratify or not.
