TO BE PERFECTLY PLAIN
AND TELL EVERYTHING
YOU KNOW. Your readers have
a right to the plain cold facts in-
tead of intimations and insinua-
tions. In this connection, the
history of this proceeding' for the
new county, so far as it pertains
to this office, is substantially as
follows:
On my return from Tulsa May
29th, I found a petition for the
formation of the new county and
while the law does not require me
to do so, I contained the hearing
of the petition until June 1st and
telegraphed to the county attor-
ney of Comanche County and to
the county attorney of Kiowa
County to know if they desired

neys were present according to
the telegraphic notice; also came
the petitioners’ committee, and
attorneys representing* Tillman
County. A hearing was had, the
county attorney of Comanche
county filing written objections
which were: First, that the pro-
posed new county did not contain
titteen thousand population.
Second, that Hunter Township,
proposed as part of the new comi-
ty , had vote i their desire to be
annexed to Tillman County. 1
requested all the attorneys to ex
amine the law upon the question
of the status of Hunter Township
and we • took a recess of a few
hours to give the attorneys a
chance to look up the legal au-
thorities, laws and court deci-
sions. Later we resumed the
hearing, the attorneys reporting
to me that they could not find any
court decisions nor laws bearing
directly on t’ at question. I then

was claimed by some of the at-
torneys that they wanted to he
annexed to Tillman County and
claimed just as vigorously l»v
their attorneys that if a new coun-
ty could he formed at all, tqpt
the people of Hunter Township
the truth of the facts set up in the
three free holders’ affidavits.
Believing that this contention
of those opposed to the new
county >vns correct, I permitted
those opposed to the new county
to oiler such evidence as they de-
sired to offer iu tln-ir attempt to
show that there was less than
fifteen thousand population in the
proposed new county After
hearing this evidence, I found
that it diil not reach the question
for the reason that the evidence
offered only showed what pui-
ported to be the population of
the proposed new county in
March 190M, and the law for the
formation of a new county treats
of the population at the time of
the hearing, which was then being
held, namely, June fourteenth,
1909 and of course the showing
as to what the population may
have been in March 1908 did not
prove the population at this time,
being more than a year afterwards.
After some consideration I sug-
gusted that to ascertain the pres,
ent population as the lav re-
quires, it would he best to have
an enumeration takeu throughout
the entire proposed new county.
Everyone present agreed to this,
the opposition acting in
harmony to name one enumerator
for eaclrtownship and the peti-
tioner* lor the county agreed to
.name ofco enumerator for each
township and each party proposed
to pay half of the cost of taking
this enumeration and I proposed
to send a superintendent to Suy-
der who would see that the enum-
erators for each township were
supplied with a census book and
were duly sworu to honestly per-
form their work. The date of

Mr. Fleming to Snyder to super-

resided in Hunter Township and
whose testimony impressed me
with his integrity and honesty of
