State Court Firm
On Vote Position
OKLAHOMA CITY (AP) The
state Supreme Court reempha-
sized Tuesday it wants 1962 leg-
islative elections held under pres-
ent apportionment laws despite
arguments by an Election Board
majority.
The court issued new orders
calling on the Election Board to
hold House elections under the
1961 House apportionment act and
senate elections under the 1941
senate apportionment act.
These laws must be followed
said the majority opinion issued
by the court or a constitutional
requirement to hold primary elec-
tions will be violated.
The new opinions came in reply
to cases filed by Harry Brown
Oklahoma City a candidate for
the Senate and T. Anita Ludlow
a Midwest City voter.
They didnt waver from the
position taken earlier by the court
that it cannot reapportion the leg-
islature itself or force the legisla-
ture to do so.

declared the board cannot accept
legislative filings under present

But the court said Tuesday that
while it had previously held that
present laws do not conform with
the constitution in all particulars
it did not hold that these laws
were unconstitutional..
Fitzgerald said the board will
reevaluate its position as soon as
it disussed the opinion with its at-
torneys. In ordering present laws follow-
ed the court declared that mem-
bers of the state Election Board
will not violate their oaths of of-
fice in administering and utiliz-
ing these laws.
The court also declared it is
hostile to a democratic system to
involve the judiciary in the poli-
tics of the people..
Among those calling on the
court to order constitutional reap-
portionment was Gov. J. Howard
Edmondson. The new opinion an-
swered his argument.
It said the governor cited no
law for the court to order elec-
tions under constitutional provis-
ions. It said the constitution pro-
hibited election of at large rep-
resentatives. Chief Justice Ben Williams con-
curred in part and dissented in
part with the six man court ma-
jority. Dissenting were Justices
Harry Halley of Tulsa and Wil-
liam A. Berry of Oklahoma City
the same lineup as on previous
reapportionment opinions.
AMA Reveals Plan
For Student Loans
CHICAGO (AP) The American
Medical Association announced to-
day a medical education loan pro-
gram that would advance students
up to $10000 over a seven-year
period and defer the payment-due
dates until they are ready to start
practicing.
The loan program is designed
to assist needy students at any
stage of thedr medical education
from Hie start of their first
year of medical school to physi-
cians in residency and training.
The loans to be offered at 5 Y2
per cent simple interest will be
guaranteed against default by the
Foundation. Guarantee funds will
be solicited from physicians and
other private sources.
