Want Sum of $121,373
The Suit Was Filed At Fort
Smith—We All Have Some
Troubles of Our Own.
Shortly after noon, Saturday,
James Bizzolara, as an attorney
for the Fruin Bambrack Construc-
tion Co., ol St. Louis, filed suit
with the clerk of the United
States court against the Fort
Smith & Western railroad for
$121,373 03 which is claimed by
the plaintiffs as the balance due
them for the construction of the
railroad Irom the Canadian river
to Guthrie.
The plaintiffs aver that they
took the contract to build this
portion of the road at a stipulat-
ed price for each class of the
work. When completed, the
whole contract called for $1,156,
648.58. Of this, $1,040,983.72
was paid, a portion each month,
to settle the claim for the month
previous. Each month a certain
percentage was witheld by the
railroad company to insure a ful-
fillment of the contract and to be
paid when all was completed.
This amounted to $11:>,G64.96.
In September, 1903, additional
work amounting to $7,058.04 and
in October, same year, $1,061,06,
was due for which they claim to
have received no compensation.
To offset this, they claim the
railroad company furnished tim-
ber to them which cost $15,866.67
leaving a balance in favir of the
Fort Smith & Western of $7,747
57. This cuts the fund which
was retained by the defendants
to $107,917.29. Extra work done
amounted to $3,455.03, bringing
the total to $11,373.03, for which i
the plaintiffs allege they repeat-
edly asked but no settlement was
made.
Furthermore, the contractors
allege that they assembled their
men, tools and team.! at Weleet-
ka where they could work at an
advantage. This was doae with
the couseut of tLie chief engineer.
Three weeks later they were or-
dered to go to liuthrie and be^iu
work from there.
They were also directed as to
the manner of transportation,
which a more experienced one
than would have beeu chosen by
the plaintiff. As this was done
for a purpose out of the custom
of railroad construction etiquette
being only to secure a bonus from
the citizens of Guthrie and to
protect their right of way.
$2,500 is asked to reimburse
them for the extra trouble and
time lost in moving.
Oklahoma's Friend.
Ex-Senator Sidney Clark, Ok-
lahoma's double statchr-Dd chain-
pion, and one of the main sup-
porters, today speaking of the
late William M. Springer, of
Illinois, in connection with the
opening of Oklahoma in 18v9,
and the long struggle preceding
the final victory, said:
"At no time during the long
controversy, did Mr. Springer
lack in his interest in Oklahoma.
It was because of his great in-
fluence and ceasless activity that
the first great victory was won,
to be followed by the passage of
the bill. In public and private
Mr. Springer had ever been a;
friend to Oklahoma. In his
sudden death, Oklahoma has
lost a friend whose memory is
worthy of the highest honor that
can be conferred upon by a
grateful people."
The dead statesman was always
true to his territory is a recog-
nized fact. He did much during
his lifetime to promote the wel-
fare of this great territory.
Among his many admirers and
personal friends in Oklahoma
none stood closer to him than did
John Havighorst of this city.
Fixing the Date.
A timid looking woman, who
had evidently never before been
on the witness stand, was being
badgered and harassed into a
state of perplexity by a smart
young lawyer, who finally said:
"Now, madatne, how do you
| know that this quarrel between
! the plaintiff and the defendant
i took place on the 17th day of
March?"
"Because I know it happened
then," she replied meekly.
"Ah! but how do you know
it?"
"Well, I—I—I know it happen-
ed that day."
"Ah! my good woman, that
won't do. We must have some
proof that it occurred that very
' y. The date must be fixed.
Can't you fix the date?"
"Well, I don't know how I
can."
"Did anything else happen
that day that don't happen any
other day at your house, or that
may not happen to-morrow?"
After a moment's hesitation
she said, brigntly:
"Yes, sir."
"Ah, indeed! What please'r"
"I had a pair o' twin boys born
that day, six."

An Able Man.
Hon. George E. Billow will
