Guthrie Okla Jan 5 — The second
Oklahoma legislature met In lta first
session a few inlnutes past noon to-
day at the new convention hall The
house and senate were formally or-
ganized Benjamin - F Wilson being
elected speaker of the house of rep-
resentatives and Clint Graham pres-
ident protem of the senate The em-
ployes were formally elected and
committees were appointed to assign
seats and to notify the governor An
adjournment was taken ' at 2:30
o’clock until 10 o’clock tomorrow at
which time the two bodies will meet
in joint session and begin business
with a canvass of the vote by which
the legislators got their seats
Lieutenant Governor Bellamy called
the senate to order Bert Tillotson
representative from Nowata and dem-
ocratic caucus leader the house The
rolls were formally called and all
members found to be present
The two bodies were administered
the oath of office sy H L Campbell
clerk of the hupreme court who acted
In the abeonce of the supreme court
Judges
Benjamin F Harrison of Calvin was
nominated for speaker pro tern of
the house The minority - “pa seed”
and Harrison’s election - was made
unanlnlous
Features of the session were the
speeches by Lieutenant Governor Bel-
lamy In which In a very dignified and
calm way he outlined the policy of
fairness and good judgment whloh he
thought should be followed Speeches
- were also made by Graham and Beel-
er in the senate both 'of some length
There was one genuine robust
cheer In the house w'hen Representa-
tive Leslie P Ross of Lawton after
a neat little speech moved that the
courtesy of the house be extended to
William H Murray who was standing
in the big crowd In the back of the
hall under the galleries A commit-
tee' was appointed to bring Murray in
which it did Both republicans and
democrats cheered the ex-speaker as
he came up the aisle and into a seat
by the speaker’s chair

message delivered by himself at the
joint session of the senate and house
of representatives 11 bills introduced
In the senate and four In the bouse
and a hot discussion In the latter
body because of the assignment of
seats to several members by the ar-
rangement committee instead of by
lot as to the other members the sec-
ond day of the Oklahoma legislature
closed late
The two houses convened In joint
session at 2 o’clock in the afternoon
wlth Lieutenant Governor Bellamy and
Speaker Wilson jointly presiding The
session was held In the representa-
tives’ chamber The ballots cast In
the last general election for Justices
Williams and Hayes and Corporation
Commissioner Watson were counted
and the voto announced The gov-
ernor then delivered his message to
the legislature the reading of which
elicited cheers from the democrats
The gavels used by Wilson Bellamy
and Graham were presented by Sen-
ator Williams on behalf of tho man-
ual training department of the Weath-
erford normal

8enator Will be Re-Elected by Legis-
lature January 20 at Noon
Guthrie Okla — United States Sen-
ator T P Gore will be re-elected to
the senate Wednesday January 20 at
the hour of noon This was decided
by the Joint committee of Senators
Thomas Strain and Brownl-ae and
representatives Japp Cope and Du-
rant yho were appointed after the
passaga of Japp's resolution to ar-
range a program Senator Thomas
of Lawton will nominate Qore
FOOD LAW VIOLATORS FINED
Shawnee Meat Dealera Plead Guilty
and Draw a Penalty
Guthrie Okla — The first conviction
under the Oklahoma pure food law
was secured in the district court of
Pottawatomie county when four
meat dealers iu Shawnee entered
pleas of guilty to the charge of selling
embalmed oysters They were fined
(25 and casts each

Coyne extending the'tlme of payment
of taxeB due January 15 to March 15
and allowing procedure to prevent or
correct Illegal or excesive tax levies

the death penalty
H B No 4 by Wortman providing
for cheaper text books and district
purchasing and handling of same

Representative Harrison Introduce a
Bill in House Providing Relief
Guthrie Okla — Means for relief of
those whose property has been irreg-
ularly assessed are provided In bouse
bill No 1 Introduced today with Bry-
an Harrison and Coyne aa authors
while the time for the payment of the
first half of the taxes levied for the
fiscal year ending July 1 1909 and
for the deficiency for the fiscal year
ending July 1 1908 Is hereby extended
until the 15th day of March 1909 and
such taxes shall become due and de-
linquent on said 15th day of March
1909and be advertised and collected
In the manner provided by law
The measure provides that any levy
for county city town township and
school district for the fiscal year end-
ing July 1 1909 and for the deficiency
for the fiscal year ending July 1 1908
which shall have been" illegally made
or exceeds the reasonable public re-
quirements may be corrected by the
proper officers of -such county city
town township or school district levy-
ing the same and in the event of the
failure or refusal of such officers to
correct such illegal levy an action to
correct the same may be brought by
any taxpayer of such county - city
town township or school district or
by the county attorney of such coun-
ty or by the attorney general upon the
direction of the governor
Where any taxes shall have been
paid prior to the passage of this act
and the levy whereof is subsequently
corrected under the provisions of this
act the excess of the amount so paid
shall be credited upon the second half
of such levy and where the amount so
paid exceeds the total amount of such
corrected levy such excess shaj be
refunded '

matter considered by the legislature
tbe past week was the governor's spe-
cial revenue bill deferring payment
of January taxes which the house
passed on third reading The bill is
scheduled to pass the house finally
Monday and to go to the senate Mon-
day afternoon Tbe special commit-
tee to which It went recommended
that the time should be further ex-
tended from March 15 to the third
Monday in April with 30 days beyond
that time until tax warrants should
issue The recommendation was ac-
cepted by the house
The first measure to pass both
houses outside of the routine matters
of organization was a house concur-
rent resolution by Japp and King
memorializing congress to extend the
time for making payments on farms
in the Big Pasture

for increased appropriations for sev-
eral departmenets of the national
guard are made by Adjutant General
Frank H Canton In his annua! report
to the governor particularly along the
line of state pay for the militia Gen-
eral Canton points out that under the
Dick bill the officers and men while
In camp receive the same pay as mem-
bers of the regular army but this
allows only 50 cents per day for the
private soldiers which Is entirely In-
adequate for the militiaman kho has

for United States senator at the gen-
eral election under a system similar to
that now in voguo in Missouri is con-
templated in a bill Introduced by Sen-
ator Yeager of Tulsa which requires
the two houses of the legislature to
vote for and elect to the United States
senate the candidate receiving the
highest number of votes at the gen-
eral election
Two Killed in Street Duel
KIk City Okla — Meeting on Main
street George Johnson and Samuel
Howard prominent business men
fought a duel with revolvers as a re-
sult of which Johnson was instantly
killed and Howard died a few minutes
later Johnson fired five shots and
Howard four!
Approves Tulsa Charter
Guthrie Okla — Governor Haskell
has approved the Tulsa city charter
the first one adopted 11 n th state
providing for a commission form of
government The charter was adopted
by tho people of Tulsa last July '
Want Convict Labor
Guthrie Okla— Representative Japp
of Comanche has presetned a petition
from' his constituents to the legisla-
ture asking that a law be passed to
work convicts on public roads to make
poll taxes payable in cash and asking
for a special road tax
