BONDS WHEN DUE AND TO
CONSTITUTE A SINKING FUND
FOR THE DISCHARGE OF THE
PRINCIPAL THEREOF AT MA-
TURITY, AND FIXING THE
OTHER DETAILS OF THE IS-
SUE.
WHEREAS, the 'own of Medford,
in the County of Grant, State of
Oklahoma, is a municipal corpora-
tion and duly organized and existing
as an Incorporated town under and
by virtue of tho Constitution and
Laws of the State of Oklahoma;
aud
WHEREAS, The said Town f Med
ford, on the 22nd day of July A. D.
1912, had and still has a legal and
binding outstanding indebtedness
amounting to the sum of $6,918.43,
evidenced by judgment of said town
regularly and legally obtained by
court procedure judgments: (1)
First National Dank vs Town of
Medford, in District Court Grant
County, - Case 1808, amount $6,885.34.
(2) Westjnghouse Electric Manufac-
turing Company vs Town of Medford,
in County Court, Case No.1828
amount $509.60. (3) Eureka Fire
Ilose Company vs Town of Medford,
in County Court Grant'County Okla-
homa, Case 1813 amount $523.49. All
of which said judgments, together
with the interest thereon, accuring
since said judgment was rendered,
amount In the aggregate to the sum
of $8,318.60; and
WHEREAS, The said Town of
Medford has no funds in its treasury
with which to pay said judgement;
and it is deemed necessary to fund
and pay the same by the issuance
of the negotiable coupon bonds of
said town to the aggregate amount
of $8,318.60, as may properly and
lawfully be done pursuant to the
provisions of an Act of the Terri-
tory of Oklahoma entitled, "An Act
to authorize the Territory of Okla-
homa, counties, cities, municipal cor-
porations, the Board of Education
of any city,and school district, to is-
sue bonds in payment of outstanding
warrant judgments," approved .March
8th, 1895, (being Article 1 of Chap-
ter 7 of the Session Laws of 1895),
as amended by an Act of the Terri-
tory of Oklahoma entitled, "An Act
to amend Section 1, of Articlel, of
Chapter 7, of the Session Laws of
the Territory of Oklahoma, of 1895,
entitled," etc., approved March 12th,
1897, (being Article 1 of Chapter 5
of the Session Laws of 1897), (6)
and the other laws and statutes of
the state complementary, supple-
mentary and enacted pursuant there-
to; Now, Therefore,
Be It Ordained by the Board of
Trustees of the Town of Medford,
State of Oklahoma:
Section 1. That for the purpose of
funding a like amount of legal, out-
standing judgment indebtedness of
the Town of Medford, In the County
of Grant, State of Oklahoma, men-
tioned in the preamble hereof, there
shall be and there are hereby author-
ized and directed to be issued the
negotiable coupon bonds of said town
in accordance with the forms pre-
scribed by the Bond Commissioner
of the State of Oklahoma, to an am-
ount aggregating the principal sum
of $8318.60 as an in the manner here
inafter provided.
And the Clerk of said town be and
Is hereby authorized and directed by
publication in the Medford Patriot,
a newspaper printed at Medford, the
county seat of Grant County, State
of Oklahoma, and of general circula-
tion in said county, to give public
notice that the Town of Medford, by
its proper officers, will on the 22nd
day of July at 10 o'clock a. m., pro-
ceed before the District Court of
Grant County, State of Oklahoma,
and then and there, or as soon there
after as it may be heard, make a
judgment inaeoieuuesH ui sum tuwu
and sign the bondB to be issued in
payment of same, at which time and
place, any and all persons interested
may appear and remonstrate against
the issuance of said bonds, which
notice shall be in substantially the
following form, to-wit:
Notice Of Intention To Fund .(6).
Notice is hereby given that on the
22nd day of July, 1912, at 10 o'clock,
a. m., or as soon thereafter as a
hearing may be had, the Town of
Medford, in the County of Grant,
State of Oklahoma, by its proper of-
ficers, will proceed before the Dis-
trict Court of Grant County, Statf
of Oklahoma, to make a showing
and ask the court to hear and de-
termine the amount of the outstand-
ing legal judgment indebtedness, ami
sign the bonds to be issued in pay-
ment of the same. The amount of
said judgment Indebtedness to be
so funded is $8,318.60.
All persons interested may be pre
sent at the time said proof is madev
to remonstrate against the issuance
of said bonds.

Section 2. That said bonds shall
be designed "Funding Bonds of 1912"
shall be 17 in number, numbered
from One to Seventeen, both inclu:
sive and of tho following denomina-
tions, to-wit: (1) $500 each except
one for $318.60; they shall bear the
date of August 1st, A. D. 1912, and
shall become due and payable on (2)
August 1st, A. D. 1932; they shall
bear interest from their date until
paid at (3) 6 per centum per annum,
payable (4) semi annually, on the
1st day of august and February of
each year, which Installments of in-
terest to date of maturity of princi-
pal shall be evidenced by appropri-
ate coupons attached to each bond;
and both principal and interest shall
be payable in lawful money of the
United States of America at (5) the
fiscal agency of the State of Okla-
homa in New York City or the State
Treasurer's office in Oklahoma
should the fiscal agency be discon-
tinued.
Section 3. That each of said bonds
shall be signed by the President of
the Board of Trustees and attested
by the Town Clerk, under the cor-
porate seal of said own (12) and
eacl} of said interest coupons shall
be eexcuted by the signatures of
said President and Town Clerk (12);
and said officers are hereby author-
ized and directed to cause said bonds
and interest coupons to be prepared,
and td execute the same for and on
behalf of said city.
After their execution as aforesaid,
said bonds, together with a certifi-
ed copy of this ordinance, shall be
presented to the District Court of
Grant County, State of Oklahoma, at
the time of the application relative
to their issuance as hereinabove set
forth; and if said Court shall find
in favor of the existence, character
and amount of judgment indebtedness
to be funded by said bonds as afore-
said, and shall order and adjudge in
favor of the issuance of said bonds,
said bonds shall thereupon be pre-
sented to and signed by the Judge
of said District court in open court,
his act being attested by the Clerk
of said court, under the seal there-
of; and thereafter said bonds shall
oe delivered to the treasurer of said
city in the manner and at the time
required by law. Said bonds shall
thereupon be duly certified by the
county clerk and county attorney of
said Grant County, and duly regis-
tered by the treasurer of Bald town
of Medford, and by the county clerk
of said county and by the State Audi
tor, as required by law, which offi-
cers shall endorse upon each bond
their respective certificates of such
registration; thereafter said bonds
shall be presented to the bond com-
missioner of tho State of Oklahoma
for his approval and endorsement;
and thereafter said bonds shall be
delivered to the purchaser of same
from the Board of Trustees of said
town upon payment of the purchase

price thereof, which shall not be less
than ninety-five per centum of their
par value, and no commission shall
be allowed or charged for the sale
of such bonds so as to reduce the
net proceeds to less than nlaety-five
per cent; provided, however, that
none of said bonds shall be issued
and delivered until a like amount of
outstanding Judgments to be funded
and paid thereby shall be delivered
up for cancellation and cancelled.
The President and Clerk of the
board of trustees of said Town of
Medford are hereby authorized and
directed, on behalf of said town, to
present the application and petition
of said town to the district court as
aforesaid, and to submit proof of
the existence, character and amount
of the judgment indebtedness herein-
above mentioned; and the acts and
doings of said officers In and about
the premises are hereby declared au-
thorized ratified and confirmed.
Section 4. That for the purpose of
providing the necessary funds to
pay the interest on said bonds
promptly when and as the same falls
due, aud also to contribute and main-
tain a sinking fund to be disignated
as "The Funding Bonds of 1912 Sink-
ing Fund," sufficient to discharge
the principal of said bonds at matur-
ity, there shall be and there Is here-
by levied on all the taxible property
in said Town of Medford in addition
in addition to all other taxes, the
following direct annual tax, to-wit:
In the year 1912, a tax sufficient
to produce the net sum of $915.05,
being $499.12 for Interest falling due
August 1st and February 1st, 1913,
and $415.93 for principal.
In each of the years of 1913 to
1932, both inclusive, a tax sufficient
to produce the net sum of $915.05,
being $499.12 annually for interest,
and $415.93 annually for principal.
Said tax shall be and is hereby
ordered certified, levied and extend-
ed upon the tax rolls and collected
by the same officers, in the same
manner and at the same time as
the taxes for general purposes in
each of said years are certified, ex-
tended and collected; that all funds
derived from said tax shall be plac-
ed in said sinking fund, which to-
gether with all interest collected on
on same, shall be irrevocably pledg-
ed to the payment of the Interest
on and principal of said bonds when
and as the same fall due.
Section 5. That this ordinance
shall be in full force and effect from
and after its passage, approval and
publication.
