A DANGEROUS PRECEDENT
FOR INDIAN TERRITORY.
Secretary Hichcock has had in-
tioduced into congress a bill to force
allotment of Cherokee lands and
dissolution of the Cuerkee nation
• without the consent of the Chero-
kee . He bases his action upon the
decision of the supreme court of the
District of Columbia iu the Lone
Wolf case, wherein that court held
that the power 'of congress is su-
preme over the Indian tribes and
their lauds, and that the consent of
the Indiau'tribe is not necessary in
• dealng with them. Viewed in the
light of the secretary that congress
has authority over all of the Ind-
ian tribes and nations alike and
that consent of the Indian is not
necessary in disposing of any of the
• Indian lands, the Lone Wolf case
is a dangerous precedent to the Ind-
ians aud to all other interests in the
'fine tribes. If congress cannot law
fully provide for arbitrary disposi-
tion of Cherokee lands without
Cherokee consent, it has the same
authority In all of the nations; if it
has that authority not*, it has had'
it all along, and the land ftade to
the M. K. &'T. railroad company, |
and the Atlantic & Pdcifie railroad '
company (now the Frisco, from I
Monett to Sapulpa) in the siztios,
must be good. Under the acts of'
congress referred to, the two roads
were chartered, and as an induce-
ment to undertake the building of,
the roads in the then waste wilder-1
nets of Indian Territory, they were
' given each alternate section of laud
for ten miles on each side of their
respectiv2 tracks through the terri-
tory. this is practically a track of
land ten miles wide from Kansas to j
Texas for the M. K. & T., and from
' Missouri to Sapulpa for the Atlan-
' tic & Pacific. The railroads were to
have these granted lands when the
Indian title was tribal title, and as
such could not endtre longer thau
' the Indian tribes, but it has been
commonly agreed that the Indian
tribes owned the'fee in the lands,

Indian tribes to individual Indians

that the Kiowa Indians were wards
of the government, and that the
United States had a right to admin-
ister their estate and dispose of
their lands without tfceir consent.
It was supposed that the rule ap-
plied to only those blanket Indians
outside c{ the five tribes, whose

more limited than the tribes of In-
dian Territory. The secretary's

Cherokees becomes a threatening
thing to the Cherokees,
Creeks, Choctaws and Chickasaw.s
