“The case has occasioned great in-
terest and doubtless each school land
lease who hears of it will be led to
believe that by reason of his agricul-
tural and grazing lease he has some
sort of right and interest in any oti
and gas that may be discovered upon
the land' said King
“There has been a great deal of
confusion occasioned by the loose
bandying about of the so-called pref-
erential right of the lessee It is well
that this question now seems to be
on the road to final determination
“It will not be necessary for each
school land lessee to institute individ-
ual suit and it is to be hoped that
the school land lessees will not eacn
incur the cost of such action both
for his interest and that of the state
One suit will determine the matter

There are more than 1(1000 lessees

King called attention to a formei
cas in which the attorney general
of Oklahoma filed a brief protesting
against claims of lessees to demand
Immediate sale of lands as a result
of preference rights to purchase guar-
anteed by the enabling act passed by
congress prior to statehood
King said: “It’s ‘the state’s posi
tion that the most that may be con-
ceded by the preferential right claus
is the right to buy when or if sold
by the state such portions of the fe
or title to the land as the state may

the act of congress or in the statute
of the state enacted subsequently im-

“This question can and will be de-
termined by the first suit which
reaches the court of last resort and
it would be equally detrimental to
both the interest of the state and
that of the individual or several lea-
sees to maintain a large number ot
suits all involving the - same que
tion " r
- “Briefly stated the position of tne
attorney general is this: A holder
of any agricultural or grazing lease
upon atate lands has no interest In
the oil and gas produced from that
land and the commissioners of the
land office are under no obligation to
sell or offer for sale and of the state
end that all may understand fully
their respective rights and privileges
“We do not have a copy of the
journal entry in the Stephens county
case and do not wish to be considered

that particular case”

five feet into the pay sand this after-
noon and flowed 300 barrels in ten

timated production of possibly 1000
barrels daily when the well is com

ing seventy barrels from two deep
sands
1 Important Find
The Herbert well is c -'-idered aii1
important find in loctal territory in
that it aids greatly in establishing
the belief that the Hudson-Gilliam-Coline
well in setion 25-4s-2w about
one and a fourth miles southeast L
an extension to the Hewitt field
There are several wells in the vicin-
ity of the Herbert well which were
abandoned some time ago as hole
which struck the water at producing
horizon but which were not drilled
to the depth of the Herbert well It!
is very likely that all these wells will 1
be deepened in an effort to reach the
Herbert sand ' j
Reports received here from Davis
