which proclamation shall be Issued at
least slaty days prior to th time of
holding said election of delegates That

of said election establish and define tn

three Judges of election for each precinct
not more than two or whom shall be of
th same political party which Judges
may appoint the necessary clerk or

In their respective precincts and canvass
and make due return of th vote cast to
the Judges of the United Btate courts In
aid Indian Territory who shall consti-
tute th ultimate and final canvassing
board of said election and whose certin-
cates of election shall be pnma fade evi-
dence as to the election of delegates and
th election for delegates in the terri-
tory of Oklahoma ahall be conducted th
returns made the result ascertained and
th certificates of all persona elected to
such convention Issued In the same man-
ner as Is prescribed by the laws of Mid
territory regulating elections for dele
Sates to congress
That th capital of Mid state shall
temporarily be at th city of Uuthne In
th present territory of Oklahoma and
shall not be changed therefrom previous
to ann Domini 191S but Mid capital may
after said year be located permanently
by the electors of Mid slate at an elec-
tion to be provided for by the legislature
I That the delegates to th con-
vention thus elected shall meet at th
eat of government of mid Oklahoma
territory on the fifth Tuesday after their
election excluding th day of election In
case such day shall be Tuesday and
after organisation shall declare on be-
half of the people of said proposed state
that they adopt th constitution- of the
United States whereupon th Mid con-
vention shall and Is hereby authorised
to form a constitution and state govern-
ment for Mid proposed state Th con-
stitution ahall be republican In form and
make no distinction In civil or political
rights on account of race or color and
shall not be repugnant to th constitu-
tion of the United Btatea and the prin-
ciples of tha declaration of Independence
And Mid convention shall provide by or-
dinance Irrevocable without the consent
of the United Btate and the people of
Mid state-
FIrst That perfect toleration of re-
ligious sentiment shall be secured and
that no Inhabitant of Mid state ahall
ever be molested In person or property on
account of his or her mode of religious
worship and that polygamous or plural
marriages and the Mle barter or giv-
ing of Intoxicating liquors to Indians are
forever prohibited
Second That th people inhabiting
aid proposed state do agree and declare
that they forever disclaim all light and
title In or to any unappropriated public
lands lying within th boundaries there-
of and to all lands lying within Mid
limits owned or held by any Indian tnne
or nation and that until th title to any
such public land shnll have been ex-
tinguished by th United Btatea the
Mme shall bo and remain subject to th
Jurisdiction disposal and control or th
United Btatea That land belonging to
cltlsens Of the United Btatee residing
without th limits of Mid state shall
never be taxed at a higher rate than
th land belonging to residents thereof
that no taxes shall be Imposed by th
tat on lands or property belonging to
or which may hermftsr be purchased by
th United BtatM or reserved tor Its
use
Third That tb debts and liabilities of
Mid territory ot Oklahoma shall bo as-
sumed and paid by skid stata
Fourth That provtalona shall bo
made for th establishment and main-
tenance of a system ot publio schools
which shall be open to all the children
of Mid state and free from sectarian
control and Mid schools shall always
be conducted In Kngllah: Provided
that nothing herein shall preclude tho
teaching of other languages in Mid pub-
lio schools
Fifth That Mid state shall never en-
act any law restricting or abridging th
right of suffrage on account of race color
or previous condition of Mrvltud
Bee A That In case a constitution and
tat government shall be formed la com
pliance with th provisions of this not
I he convention forming th Mme shall
provide by ordinance for submitting said
constitution to tho people of Mid pro-
posed state for Its ratification or rejec-
tion at an election to bo held at n time
fixed In said ordinance at which i no-
tion the qualified voters of said proposed
state shall vote directly for or against
the proposed' constitution and for or
against any provisions separately submit-
ted The returns of said election shall
be mad to th secretary of th territory
of Oklahoma who with the chief Justice
thereof and th chief Justice or Minor
Judge of Indian Territory shall eanvaaa
th Mme and If a majority of the legal
voles cast on that question shall be for
the constitution the governor ot Oklaho-
ma territory and the Judge senior In Mr-
vloe of Indian Territory shall certify the
result to the president of the United
Btatee together with th statement of
th votes cast thereon and upon Mpar-
ate articles or propositions and a copy
of said constitution articles propositions
and ordinances And If the constitution
and government of Mid proposed state
are republican In form and If the pro-
visions of this act hav been compiled
with In th formation thereof It shall
be th duty of th president of tbs United
B tales within twenty day from th re-
ceipt of th certificate of the result of
Mid election and th statement ot votes
cast thereon and a copy of Mid constitu-
tion articles propositions and ordinances
from said eomlsslon to Issue bis procla-
mation announcing the result of Mid
election and thereupon th proposed
tat of Oklahoma shall be deemed ad-
mitted by congress Into the union under
and by virtu of this act on an equal
footing with the original states from and
after th fourth day of March 1SU4 Th
original of Mid constitution articles pro-
positions and ordinances and the election
returns and a copy of the statement ot
th votee cast at Mid election shall be
forwarded and turned over by the secre-
tary ot th territory of Oklahoma to tho
state authorities of said state
Bee i That th aum of one hundred
thouMnd dollars or so much thereof as
may be necessary la hereby appropriated
out of any money In the treasury not
otherwise appropriated for defraying the
expenses of Mid election and convention
and for the payment of th members
thereof under th same rules and regula-
tions and at the Mm rale as are now
prodded by law for the payment of the
territorial legislature of the territory of
Oklahoma
Bee That until the next general
census or until otherwlM prodded by
law the said state of Oklahoma shall be
entitled to fIV representatives In th
houM of representatives of th United
States to be elected from th following
described districts- th boundaries ot
which shall remain th same until tbs
next general census:
That district numbered one shall com-
prise the counties of Urant Kay Oar-
field Noble 1’awne Kingfisher Uogan
Payne Lincoln and the territory com-
prising the Osage and Kansas Indian res-
ervations That district numbered two shall com-
prise the counties ot Oklahoma Can-
adian Blaine Caddo Custer Dewey
Day Woods Woodward and Beaver
That district numbered three shall com-
prise all th territory now constituting
the Cherokee Creek and Bemlnole nations
nd th Indian reservations lying north-
east of th Cherokeo nation within Mid
state -
That district numbered four ahall com-
prise all that territory now constituting
th Choctaw nation and that part of the
Chick smw nation lying east of th range
line between ranges two and three east
of th Inman meridian
That district numbered five shall com-
prise the counties of Greer Koger Mills
Kiowa Washita Comanche Cleveland
and Pottawatomie and that part of the
territory comprising th ChlckaMw na-
tion lying west of the rang line between
ranges two and three east of the Indian
meridian
And the Mid representative to the
Fifty-ninth congress together with the
governor and other officers provided for
In Mid constitution shall be elected on
the Mme day of tha election for tha rati-
fication or rejection ot th constitution:
and until Mid officers are elected and
qualified under the provisions of suen
constitution and the Mid state admitted
Into the union the territorial officers ot
Oklahoma shall continue to discharge the
duties of their respective othces In said
territory
Bee f That upon th admission of the
state Into th union sections numbered
sixteen and thirty-six In every township
In Oklahoma territory and all Indemnity
lands heretofore selected tn lieu thereof
are hereby granted to the state for the
um and benefit of the common schools:
Provided that sections sixteen and
thirty-six embraced In permanent reser-
vations for national purposes shall not at
any time be subject to th grant nor tn
indemnity provisions of this act nor shall
any lands embraced In Indian military
or other reservations of any character
nor shall land owned by Indian tribes or
individual members of any tribe be sub-
jected to th grants or to the indemnity
provisions of this act until th reserva-
tion shall hav been extinguished and
such lands be restored to and become a
part of the publle domain: Provided
that there Is sufficient untaken publle
land within Mid state to cover this grant:
And provided that in com any of the
lands herein granted to tb state ot
Oklahoma hav heretofore been con-
firmed to the territory of Oklahoma for
the purposes specified in this act the
amount so conllrmed shall be deducted
from the quantity specified In this act
There la hereby appropriated out of
any moneys in the treasury not other-
wise appropriated the sum ot riva million
dollars for th us and benefit of the com-
mon schools ot Mid state In lieu of sec-
tions Btxleen and thlrty-slx and other
lands of the Indinn Territory Bald ap-
propriation ahall be paid by th treasurer
of the United States at such tlms and to
such person or persona as may be author-
ised by Mid state to receive tb Mme
under Inws to be enacted by Mid state
and until said state shall enact such laws
Mid appropriation ahall not be paid but
Mid state ahall be allowed Interest there-
on at the rat of three per centum per
annum which shall be paid to Mid state
for th use and benefit of Its publio
schools Bald appropriation of five mil-
lion dollars shall be held and Inveated
by Mid state In trust tor th use and
benefit of Mid school and th Interest
thereon ahall be paid quarterly and used
exclusively In th support and mainten-
ance of Mid schools: Provided that
nothing In this act contained shall repeal
or affect any act or congress relating to
th Sulphur Springs reservation as now
defined or as may be herearter defined or
extended or th power of the' United
States over It or any other lands em-
braced In the state hereafter set aside by
congress as a national park gam pre-
Mrve or for th preservation ot objects ot
archaeological or ethnological Interest
and nothing contained In this act ahall
Interfero with tbs rights aaS ownership
of tn United States In any land hereafter

extended by law but exclusive legisla-

Springs reservation or national parka

heretofore selected In lieu thereof here-
tofore reserved under Mid proclamation
and acts for charltabl and penal Instltu-
tlona and public buildings shall b ap-
portioned and disposed of as th legis-
lature of Mid state may prescribe

common schools may be appraised and
old at publio rale In one hundred and

rules and regulations as the legislature

fore any of the said lands shall be sold

ments thereon shall be appraised by
three disinterested appraisers who shall
be nonresidents of the county wherein
the land la situated to be designated as
the legislature of said state snail pre-
scribe and the Mid appraisers shall make
a true appraisement of Mid lands at th
actual cash value thereof exclusive of
Improvements and shall separately ap-
pralM all permanent Improvements
thereon at their fair and reasonable
value and In case the leaMholder does
not become the purchaser th purchaser
at Mid Ml ahall under such rules and
regulation as th legislature may pre-
scribe pay to or for th leaMholder th
appraised value ot said Improvements
and to th state th amount bid for th
Mid lands and at the Mle no bid fof
any tract at less than th appralMment
thereof shall be accepted

at South McAtester and on term at
Ardmore each year and th circuit and

the Mid districts shall for Judicial pur-

keep his office at Muskogee and Uuthne

first Monday in Juno at Ardmore on tn

each yrar and only on grand Jury and
on petit Jury shall be summoned in
each of Hid circuit and district courts
Th circuit and district courts tor each
of Mid districts and th Judges thereof

by th other circuit and district courts
and Judges of the United Mutes and
hall be governed by th Mme laws and
regulations The marshal district at-

tion now allowed by taw to officer per-
forming similar services for the United
States In the territory of Oklahoma and
that the laws and procedure of th pres-
ent territory of Oklahoma as far as
applicable shall extend over and appiy
to Mid state until changed by the tegia-
tatura thereof

writs of error heretofore prosecuted and
now pending in tb supreme court ot

appeals for the eighth circuit upon any
record of the supreme court ot raid ter-
ritories or that may hereafter lawfully

either of said courts may be heard and
determined by raid supreme court of th
United BtatM and the said circuit court

tion or other proceeding shall be directed
by the supreme court of th United

the circuit or district courts hereby es-
tablished urlthln the Mid state succeed-
ing the lemtoriM from which such reo-
ord la or may be pending or to th su-
preme court of Mid state or other state
court therein Mtablished as the nature

proceedings and matters now pending in
the supreme or district courts ot Mid
territortes at the Urns of admission as a

such state whereof th circuit or dim

courts existed at the tlm of the com-
mencement of such cases the said cir-
cuit and district court each respective-
ly shall be th successors of Mid su-
preme and district court of said terri-
torira and In respect to all other cases
and matters pending In the supreme or
district courts of said temtones or la
th United Btatra courts for mid terri-
torira at th time of th admission of
such state arising within th limits ot
Mid proposed state the courts of Mid
state shall respectively be the succes-
sors of raid suprem and district terri-
torial courts and the United Btatra
courts In said territories And all the
files records indictments and proceed-
ings relating to any such cases shall D
transferred to such circuit district and
tat courts respectively and the rams
hall be proceeded with there in due
course of taw but no writ action In-
dictment cause or proceeding now
pending or that prior to the admiraion
of Mid state shall be pending In any
territorial courts of Mid territories or
th United BtatM courts for said terri-
tories shall abate by the admission of
raid state Into the union but th ram
shall be transferred and proceeded wita

trict or other state court as th case
may be: Provided however that In au
civil action causes and proceedings In
which the United BtatM Is not a party
transfer shall not be mad to th circuit
nd district courts of th United Btatea
except It be a case which under existing
laws might be transferred from a state
court to the courts of the United Btatea
and upon written request of one ot tn
partlM to such action or proceeding
filed In the proper court as now by law
required and in th absence of such re-
quest such cases shall be proceeded with

tion may by ordinance provide for the
election of officers for a full state gov-
ernment Including members of the legis-
lature and five representatives to con-
gress and may attach th Usage Indian
reservation to counties contlnguoua or

and designate the county seat thereof
and shall provide rules and regulations
and define th manner of conducting tne

vention shall proceed to exercim all tne

laws of Mid territories In force therein

Indian inspector’s office that accord-
ing to an amendment to the regula-
tions governing oil and gas leases in
the Creek and Cherokee nations ap-
proved December 27 ' 1905 lessee
shall not bo allowed to drill for oil
or gas well within one bundfed ana
fifty feet of the division line between
the lands covered by their lease and
adjoining lands whether the latter
lands are leased or nnleased allotted
or unallotted
This gives protection to the lessee
whose lease has not been approved
Thero have been many complaints of
cases where a driller on an approved
lease put down n well n few feet from
the dividing line ot n lease that has
not D-ten approved thereby draining
the ou from the lease adjoining
