School District Changes
Tie decision of the County Com-
missioners March 6th sustaining
the action of the Cnuuty Superin-
tendent of Feb 6t!i made possible a
new school district near Jay of Dela-
ware County The new district is
composed of portions of districts 62
26 33 and 82 and is 3 miles long by
2 miles wide The next step will be
a school meeting of the newly initi-
ated district 'in which offloers will be
choseu The number of this district
will be 69 '
A proposed change in school dis-
trict 41 where Oaks is located is
now on foot and It in likely that tlie
prayer of tlie petitioners asking for a
new district will be granted Tlie
proposed district will ' embrace 4
sections in one of which Oaks is lo-
cated The people there Iiave longed
for a new school house and a new
district and it is probable that their
wisheis will be grunted

Kansas Tribune that Delaware
county had been outrageously held
up and robbed because the county
commissioners of that county saw fit
to employ a paper that was able to
handle the work to print tlie county
commissioners’ 1 proceedings at 25 1
cents per square when the legal and
lawfully correct rate is 75 cents per
square They say the county was de-
frauded because the work wasn't put
in the hands of the cheapest work-
men We don’t say that tlie otiier
papers in-Delaware ceunty are not
able to do tlie work in question but
we know the Grove Hun can do it
and do it right But it is just us log-
ical for somebody to holler “graft’
if the board would fill a county deputy-ship
where the Hillary Ih supposed
to be $76 per moiitli with a man
Whom they paid $25 because suiue
person offered to do the work at 10
cents per hundred years There is a
little more to be considered than
eternal cheapness but as long as
some newspapers think their labor
and spaoe Is of no value they will

newspaper to publish legal notices
to publish tlie County Commission-
ers’ proceedings and to publish the
dtdinquent tax lists I submit tlie
following: References are to 1909
Statutes of Oklahoma
Sec 6103 pm v Ides : No legal notice
advertisement or publication of uny
kind required or provided by any of
tlie laws ot the State of Okla-
homa to be published in a news-
paper shall Iiave any force or effect
as such unless tlie same be published
in a newspaper of the county having
general circulation therein and
which newspaper has been contin-
uously and uninteruptedly published
in said county during tlie period
(Passed in 1897)
Sec 6266 provides: That all legal
publications heretofore made I n
newspapers having one side of tlie
paper printed away from tlie office
of publication and known as patent
insides or patent outsides shall Iiave
the same force and effect as if pub-
lished iu newspapers wholly printed
nnd published in such county where
such publication was made’’ (1893)
See 6267 provides: That all publi-
cations aud notices required by law
to be published In newspapers in this
State if published iu newspapers
having one side ot the paper printed
away from the office of publication
known as patent outsides or insides

as though the same were published
in newspapers printed wholly and

terpretation In various states- but
nowhere does publish and print mean

It is very clear from tlie wording
of the first section quoted above that
tlie Commissioners proceedings can
not be published in a newspaper
printed wholly outside tlie State of
Oklahoma or County of Delaware
I construe the words “newspaper
n tlie County" as used in connection
witli the second section to mean a
legal publication sucli as is defined
by tlie statute and this would not
admit of such publication in a news-
paper printed wholly outside tlie
County of Delaware
I construe ilie words “published in
tlie county” in connection with the
provisions or law relating to legal
publications and give the word “pub-
lished" tlie same meaning as tlie
word “printed" which it does not
usually carry To not do tills would
require a different publication for
personal property delinquents than
for real estate delinquents which the
statute did not contemplate
In regard to tlie provisioua of tlie
law relative to the publication of no-
tices by guardians and administra-
tors I find that the word “printed
In the county" Is used very frequent-
ly and I do - not believe a paper
printed wholly outside the county of
Delaware haa any right to publish
such legal notices '
