statement in writing with the Board
of County Commibsioneis of Okla-

drain and report of an estimate of
the amount oi work required to clean

WHEREAS upon the 12th day of
April 1923 the said Drainage Com-
missioner and Floyd W Bruce a Civil
Engineer did report as follows

Crutcho Township Oklahoma Coun-
ty Oklahoma which petition prays
that a township road be located open
ed and established on the following
described route:
Beginning at the 1-4 Section cor-
ner to Sections 11 and 14 Township
12 North Range 2 West of the I M
thence North 1208 ft thence along a
curve to right of 100 feet radius a
distance of 1576 ft S 89 degrees 36
minutes thence East 12869 ft thence
South 2110 ft to a point on the line
between said Sections 11 and 74 of said
Township and Range said point be-
ing 13700 ft easterly from the said
1-4 section corner of said sections ly-
ing in Oklahoma County Oklahoma
And it appearing that the said reso-

RULES OP THE DISTRICT
COURT
1- Session or the court will be
uptned each morning at 9 o’clock
and the noon adjournment shall be '
from 12 M to 1:30 P M uuicss
otherwise specially ordered
2 No leave will be given to file
a motion or other pleading out of
time without the consent of the ad-
verse party or notice thereto of
the hour when application for such
leave will be presented to the court
or judge '
3 No motion or demurrer will
be entered on the motion docket
except at the instance of an attor-
ney interested therein nor shall
the same atand for hearing until
at least three days after it shall
have been filed and two days aftei
its entry on the motion docket
Unless otherwise ordered by the
Court said motion docket will be
called each Saturday morning un-
contested motions and demur-
rers will be first disposed of
after which the call will pro-
ceed in the order of entry on the
motion docket and if the at-
torney representing a motion or de-
murrer is not present when the
same is called such motion or de
murrer will be'dismisaed
4 At the opening of court each
morning the assignment of cases
for trial that day will be called If
the plaintiff doea not respond upon
such call hia case will be dismissed
at his cost If a defendant fails to
respond upon such call a default
may then be entered against such
defendant
5 In all criminal cases if the
defendant does not respond upon
call of the assignment of his case
as is provided in Rule 4 hereof pre-
ceding his bail shall be forfeited
and an alias warrant issued for his
arrest
6 Attorneys and litigaints are
expected to be prepared for the
trial of cases on the datea to which
the same are respectively assigned
and an agreement of counsel for
any other disposition of a case than
a dismissal thereof must be ap-
proved by the Court or the tame
will be ignored
7 Counsel shall at the time
of filing any pleading or motion
deposit with the clerk one true and
complete copy thereof for each ad-
verse party or group of parties
whose interests are not identical
with each other or deliver such

copy to the party thereto entitled

8 An attorney receiving an or
der for judgment shall within three
days thereafter furnish to the Court
Clertc a form for the JOURNAL
ENTRY thereof which except in
case of order of default or dismis-
sal sha' be evidenced by an “OK
endorsed thereon signed by tne at-
torneys representing alt parties to
the action
9 No divorce suit Will be heard
upon its merits until after the ex-
piration of thirty days from the
date of filing of the petition nor
until after the defendant shall have
been served with process either ac-
tually or constructively or shall
have filed with the Court Clerk a
written waiver or such service duly
executed and acknowledged before
an officer authorized to administer
oaths and — divorce will be
granted up icorroborated
statement admin or testimony
of the party concerning the grounds
relied upon for a divorce Pro-
vided that all uncontested divorce
cases may be set for trial on the
second or fourth Saturdays of each
calendar month
10 The court clerk in making
up the trial docket shall assign
criminal and non-jury cases onlv
for a period of at least one week
beginning on Monday of the first
week in each calendar month He
shall ascertain the defendants who
are in jail and give the assignment
of their cases preference over de-
fendants on bail The non-jury
cases to be assigned for such week
shall be those in which the parties
shall have filed a waiver of jury trial
or which appear from the plead-
ings to be non-jury rases
11 The Court Clerk snail make
a trial docket assigning such num-
ber of cases for each' trial day as
the Judges of the Court may find
time to give consideration and
shall frotirday to day cause to be
printed in The Daily Legal News
in the order appearing in said trial
docket a copy of said assignment
of cases in such manner as that
each case so appearing on said
trial docket shall thereafter appear
in' its order in said Daily Legal
News twenty days prior to the date
to which it is assigned on said trial
docket and said publication shall
constitute official notice of such
assignments foi rial-

added to tne triai docket so pre-
pared by the Court Clerk nor any
alteration made therein -xeept
upon order of the Court ith full

tion of and approved by the Court
at least ten days before the date
on which the case is assigned for
trial Provided that the statutory
continuance may be granted at any
time upon statutory grounds Any
case continued shall be reset only
by order of the Court on notice to
all parties or regularly set by the
Court Clerk
15 Reports of referees and ex-
ceptions thereto shall be assigned
by the Court Clerk as other non-
jury cases but where no exception
are filed to such reports the same
shall be deemed and stand for trial
as a default case ’
16 In any case lit which the
Court shall find any motion or
demurrer to be frivolous the Court
shall so publicly declare and ad-
judge the same to be frivolous and
the case shall stand for trial in like
manner as if an issue of fact had
been joined in the first instance
