AMENDING SECTION J005 OF THE
REVISED LAWS OF OKLAHOMA
1910 PROVIDING PENALTIES FOR
THE VIOLATION OF THE INTEREST
laws of the state and dent-
ing THE JURISDICTION OF THE
COURTS TO ENFORCE USURIOUS
CONTRACTS IN CERTAIN CASES
PROVIDING FOR REPORTS TO THE
BANK COMMISSIONER BT STATE
BANKS CONCERNING RATES OF IN
TEREBT AND FIXING THE PROCED-
URE FOR THE CANCELLATION OF
THE CHARTERS OF SUCH BANKS
VIOLATING THE INTEREST LAWS
OF THE STATE’
Fagged by the Extraordinary Session of
the Fifth Legislature -
Be It Enacted by the People of the State
of Oklahoma:
Section 1 Section 1006 of the Revlaed
Law a of Oklahoma 1910 Is hereby amend-
ed to read as follows: - 1
“The taking receiving reserving or
charging a greater rate of interest than
is provided by the preceding sections
shall be deemed a forfeiture of twice the
amount of interest a hich the note bill or
other evidence of debt carries with it or
which has been agreed to be paid thereon
In case a greater rate of interest hag been
paid the person by whom It has been
paid his legal representatives may re-
cover from the person firm or corporation
taking or receiving the same In an action
In the nature of an action of debt twice
the amount of the entire interest paid
provided that such action shall be
brought within two years after the matur-
ity of such usurious contract provided
further that when any suit Is brought
upon any note bill or other evidence of
Indebtedness or to foreclose any mortgage
or lien given to secure such Indebtedness
when a greater rate of interest has been
collected reserved charged or received
than Is provided for In this Act the de-
fendant or hls legal representative may
plead as a set-off or counter-claim in said
action twice the amount of the entire in-
terest collected reserved charged or re-
ceived in said transaction or in all such
transactions between the same parties"
Sec 2 Any contract for the loan of
money where the rate of interest taken
received reserved or charged is greater
than the rate as declared In Section 1004
of the Revised Laws of Oklahoma 1910
may be liquidated in the following man-
ner: On the date such contract falls due
or at any time before suit for the col-
lection thereof is instituted the payer
his agent attorney or legal representa-
tive may tender to the holder thereof the
exact amount of money received from the
lender less the amount of the entire In-
terest charged received reserved or col-
lected thereon said tender to be In writ-
ing and the payee of said contract Is
hereby given twenty-four hours there-
after to accept or reject such offer and
such acceptance or rejection shall be in
writing and the acceptance or rejection
thereof shall constitute and be a full and
complete satisfaction of such Indebted-
ness If no such tender as heretofore
provided has been made and suit is in-
stituted in a court of competent jurisdic-
tion for the collection thereof the payor
his agent attorney or legal representa-
tive may at or before the time he Is re-
quired to plead deposit in the court the
exact sum of money received on said con-
tract less the eaxet amount of the entire
Interest taken received reserved or
charged and the cost incurred and if the
same be not accepted the court or jury
shall make a finding thereon and the
judgment against saul plaintiff shall be
rendered on said finding holding such
contract and debt satisfied by reason of

RELATING TO THE QUALIFICA-
TIONS OF ELECTORS AND PRE-
SCRIBING THE PROCEDURE' FOR

SION OF SAID PROPOSED AMEND-

Be It Enacted by the People of the State
of Oklahoma:
Section 1 That the following amend-
ment to article 3 of the Constitution of
the State of Oklahoma to be designated

en of this State to vote shall ever be
denied or abridged on account of race
color or previous condition of servitude
"No person shall be registered as an
elector of this State or be allowed to
vote or be eligible to hold office under
the Constitution and laws of this State
unless he be able to read and write any
section of the Constitution of the State
of Oklahoma but no person who prior to
the adoption of this provision served in
the land or naval forces of the United
States or In the war with Mexico or on
either side in any war with the Indian
tribes located within the United States
or on either side in the Cli tl War or in
the National Guard or militia of any -State
or Territory of the United States or In
the land or naval forces of any foreign
nation and all lawful descendants of any
such person and of those that served on
the side of the Colonies In the American
Revolution and in the land or naval
forces of the United States in the War
of 1812 or any person prevented bv phys-
ical disability from complying with such

est on any note bill or other evidence of
debt and who shall transfer the same tc

be liable to the maker of said note biU
or other evidence of debt for double an

ceived provided that the purchaser of
any note or evidence of debt with notlcs
or knowledge that tbe same was executed
In violation of the Interest laws of tho
State shall not be deemed an Innocent
purchaser and such contract shall bs
held subject to all the defenses and pen-
alties provided In this Act provided fur-
ther that causes of action for the recov-
ery of penalties created in this Act shall
not be assignable
Sec 4 No suit upon any contrast en-
tered into after the passage and approval
of this Act of 300 00 or less or an action
in replevin or to foreclose any mortgage
or lien feiven as security therefor shall
be maintained in the courts of this State
and no petition or bill of particulars shall
be filed or any process Issued where the
amount of such sum is 330000 or less un-
less at the time of filing such suit there
shall be filed with such bill of particulars
or petition an affidavit setting forth
that the contract sued on was not made
In violation of the interest laws of this
State and that a greater rate of Interest
than ten per cent haa not been charged
reserved or collected upon such contract
or contracts sued upon provided that If
upon the trial of any such suit brought
upon any note bill or other evidence of
indebtedness of 3300 00 or less or in re-
plevin or for the foreclosure of any lien
given to secure the same It shall be
shown by the evidence that the contract
sued upon is usurious and made tn vio-
lation of the Interest laws of this State
said suit shall be dismissed at the cost of
the plaintiff
Sec 5 It shall be the duty of the of-
ficers of all State banks organized and
doing business under and by virtue of tho
law s of tho State to make a sworn quar-
terly report to the Bank Commissioner
setting forth the rate of Interest charged
retained reserved or collected upon the
loans made in excess of the legal rate of
Interest during thd quarter from which
sold report Is made and such other de-
tailed information as the Bank Commis-
sioner may require concerning rates of
interest charged and all such reports as
show the rates of interest exceeding ten
per cent per annum have been charged
shall be published in the annual report of
the Bank Commissioner provided that
when the report of any bank shall dis-
close that such bank Is wilfully loaning
money In violation of the Interest laws of
the State it shall be his duty to Imme-
diately report such violation to the Gov-
ernor who may direct the Bank Commis-
sioner to bring suit through the Attor-
ney General in a court of competent Jur-
isdiction In the county where the bank is
located to cancel the charter of such
bank and the judgment of the court on
the trial of said Issue shall find the de-
fendant bank guilty or not giltltv and If
the judgment is guilty it shall further
provide for the cancellation of the charter
of said bank and the liquidation-of the
assets of said bank as the law now pro-
vides in cases of insolvent banks from
which judgment either party shall have
the right to appeal to the Supreme Court
as In civil cases Upon such appeal being
filed the Supreme Court shall hear and
determine same as an advanced case

accordingly be adopted and become effec-
tive See 2 It shall be the duty of the Sec-
retary of State to refer said proposed
amendment to the people at a special
election to be held throughout the State
on the first Tuesday in August 1916 and
such special election Is hereby ordered
for such purpose
Sec 8 Said proposed constitutional
amendment shall be referred by the Sec-
retary of State to the people at such spe-
cial election for their approalv or rejec-
tion The Secretary of State shall cause
an attested copy of said proposed amend-
ment so proposed by this Act or Joint
Resolution to be filed with the Chairman
of the State Election Board together
with a certificate of the fact that Raid
amendment was proposed by Act or Joint
Resolution of the Legislature setting
forth such resolution Smd proposition
shall be cauaed to be printed by the
State Election Board as may be provided
by law In said special election to be
held on the first Tuesday in August
1916 the electors qualified at that time
to vote at any election in the State may
vote on said amendment It shall be tbe
duty of the proper officials to cause to be
printed on a separate and independent
bajlot or any ballot on which Constitu-
tional Amendments or other propositions
submitted by the Legislature to the peo-
ple for approval or rejection may be
placed the form of the ballot to be that
as prescribed by law the following bal-
lot title
“Proposition prohibiting property qual-
ification but imposing literacy test for
electors excepting those who served in
army or navy of the United States In war
with Mexico or on either side in wars
with certain Indian Tribes or on either
side In Civil War or In war with Spain
or of any foreign nation or in National
Guard or militia of any States and all
lawful descendants of such persons and
of those that served on the side of the
Colonies In American Revolution and in
War of 1819 and those prevented by phys-
ical disability from complying with such
teat 1
