DRAFT LAV BEYOND ATTACK
’Washington Aug 20 — Jndge
Speer’s decision in the first case
brought to test the Selective Draft
Law was mad public tonight by
the Department of Justice Any
question as to the act’s constitution-
ality officials ’ believe is definitly
and completely disposed of by a
supreme court decision cited by the
Georgia judge It was in tbe case
of the United States versus Tarble
and tbe j?ourt said:
“Among the powers assigned to
the national government is the
power to raise and support armies
Its control over the subject is
plenary and exclusive It can
determine wilhoot question from
any state authority how tbe army
shall be raised whether by voluntary
enlistment or farced draft tbe age
at which the soldiers shaH be re-
ceived and the period for which
they shall be taken tbe compen-
sation he shall be allowed and tbe
service to which he shall lie as-
signee” Judge Speer held that soldiers
were not slave- and that therefore
the contention that the law was in
contravention of the tbirteelh
amendment against involuntary
servitude was empty
Come and hear them and have
part in the worship of our God —
