OOBPELL,
l. That all sidewalks hereafter constructed or repaired, where
sack repair oost so much aa baildiag same, upon aay of the streets or avsansa
of sak! towa, shall bo by special assssssiient upon the abutting lota, aad said
Iowa shall lane a tax warraat against each separate lot, aa hereia provided,
which shall he a valid Ma tbereoa: provided, said town shall not be liable for
said warraat or aay part thereof.
See. 2. That upon the filing of a petition signed by ten or more citiaoaa of
this towa, with the Board of Trustees, praying for tbe constructioa of a side
walk along aay of the streets or avenues of said towa, the board of trustees
may. If la their judgment the same shall lie necessary, order said walk to be
built; provided, that the board of trustees may, in their discretion, o/der side
walka to be built without su<*h petition.
Sec. 3. When tbe board of trustees shall have ordered any aidewalk to be
built or repaired, as provided in seotionfl of this ordinance, along any of tbe
streets or avenue* of said town, by special aaaessment, the street commissioner,
or in tbe absence of such officer, the town marshal shall give a written or
printed notice to tba owner or agent of anch owner of all lota abutting upon
auch street, if the ownet or agent be found. If the owner or agent can not be
found, such notice may be nerved upon the occupant of such lot. If no owner
or agent be found, or if tbe lot be unoccupied, no notice shall be neceeaary, but
tbo street commissioner or town marshal, as the case may be, shall make a re-
turn on such notice to the office of the town clerk, showing the person upon
whom service waa made, or the reason why no service was made, which shall be
filed in tbe office of tbe town clerk of said town. Said notice shall describe the
lot, aloag which such aidewalk is to be built, by its number, and aball notify
him that tbo board of truatees have ordered the same to bo built, or tbe coat of
baildiag aame turned over to tbe street commissioner or to tbe town marshal,
as the cass may be, within ten days from the service of sach notice, or a tax
warraat, for actual oost of labor and materials used, to which will be added tbe
clerk a ooata and costs of publication and the penalty of 25 per cent, will be is-
aned, which will be a special assessment against such lot.
Hoc. 4. If any such owner or agent of such lot shall fail to construct such
sidewalk, or pay tbe amount required in such notice to tbe street commissioner
or town martha), as the case msy be, withia ten dsys sfter tbe service of such
aotice, the street commissioner or marshal shall report such fact to the board of
trastees, whereupon said board shall contract with some person or persona to
construct such sidewalk, at a cost not exceeding the actusl cost of labor and
materials at the usual market price of same, which shall not be more than the
amount named in the notice served or attempted to be served by such street
commissioner or town marshal, and said board of trustees shall issue a tax war-
raat against such lot for such amount to pay for same, provided, such person
or persons so contracting accept for constructing such sidewalk such tax war-
rant, against anch lot. without said town becoming liable for said amount or
any part of the same; and provided that said construction be done under the
supervision of the street commissioner or tbe town marshal.
Sec. 5. That the tax warrant issued shall be filed with the town clerk of
said town, and a notice of its issuance shall be published in some newspaper
published in said town, for four weeks And if, at the expiration of such notice,
tbe amount named in said warrant with fees of the clerk and costs of publica-
tion shall not be paid, said fees and cost", with a penalty of 23 per cent shall be
added to said tax warrant and made a part of the original assessment and col-
lected as a part thereof. And the town clerk of said town shall list each of the
tax warrants, issued as aforesaid, with a full description of the property therein,
with all the costs and penalties thereon, and present the same to the county
clerk of Washita county at tbe time when said clerk shall transmit the annual
levy of said town,
8ec. 6. That all ordinance or parts of ordinances in conflct herewith are
hsrsby repealed.
8ec. 7. That this ordinance shall be in force and elect from and after its
and publication.
