Barnhart Discharged
Upon motion of County Attor-
ney Conner, the case ot the Ter-
ritory vs. Charlie Barnhart, for
the larcency of domestic annuals,
was dismissed Thursday after-
noon. , •
Barnhart became involved in
this trouble through Frank
Southworth, who has been con-
fined in the county jai. here for
stealing a horse from Dan Hurst.
At that time it was generally
supposed that there was a band
of horse thiefs operating in the
county, and in order to And them
out and bring them to justice.
Southworth was promised im-
munity from prosecution, H he
would turn states evidence
against his fellow-criminals. So
he went before the grand jury
aud procured this indictment of
Barnhart and a number of oth-
ers, and therefore regained his
freedom.
In the meantime Hurst moved
away and could not be fonnd to
prosecute the case, and South-
worth was the only one upon
whom the prosecution could rely
for conviction. Therefore a trial
under such circumstances would
have been a farce. Hence the
ease was dismissed. - Hobart

tract therefor is entered into
with husband and wife by one
furnishing material for improve-
ments on a homestead. Held, that
no lien attaches to such home-
stead by reason of the filing of a
mechanic's lien thereon, and a
decree of foreclosure of such
lien is properly denied.
The case was carried up on
on the theory that the hotel was
not a homestead, but the court
seems to have taken no cogni-
zance of this contention evident-
ly presuming from the record
that there was no grounds for
such contention.
