Supreme Court Refuses to Issue Or-
der Compelling Mayor Stearns to

court, the supreme court failed to hard
down a decision today In the manda-
mus case from Shawnee Involving the
controversy between the Herald an'l
the News as to the printing of the
new city charter. The Herald has be i,i
designated as the official city paper
of Shawnee by the city council which
is democratic, but Mayor F. P. Stearns
a republican, turned the charter over
to the News, a republican paper, for
publication. The Herald claimed th it
it should go with the other city print-
ing. and brought mandamus proceed-
ings against the mayor to compel him
to furnish it with a copy of the char-
ter The failure to decide the case 1j
virtually a defeat for tue Herald,
which had to have the charter for
publication today in order to get it tu
for the required number of days.

in connection with the rejuvenation of
Turkey and the granting of the consti-
tution, the Turkish women have abn-
doned the veils which have always

TO CONTEST
The News Is loath to make public
the controversy In regard to the pub-
lication of the propose1 —ity charter,
as it might give the >.ipression that it
is a newspaper tight. The publtcatiu.i
in the press of the state, however,
makes some explanation necessary. 11
the first place, the News made no
fight for the publication of the chart-
er. It came to the News entirely un-
solicited. In fact, the News was call-
ed upon by the mayor and the board
of freeholders to help them out of a
hole. When the contract with the
Herald to do Pity printing was made
the Herald publication of their week ]
Whon the time to publish the propos-
ed charter came, It was ound that
for some reason or other the Herald
had ceased publication of their week-
ly since the first of July. The con-
stitution provides for the publication
of a proposed city charter in a dallv
paper 21 times, or in a weekly three
times. When the charter was ready for
publication, the Herald demanded the
copy, and put their price for publi-
cation at something over $2100. Mhen
asked why the price was so high, the
Herald representatives replied that
they had ceased publication of their
weekly and would have to publish it
21 times in the daily.
The mayor was unwilling that the
people of Shawnee should be stuck for
$1800 more than was necessary, and
stated that he would refuse to have !t
published at sucn a price. The free-
holders. all of whom are democrats,
concurred with the mayor, and sent
for representatives of The News to
confer with them. The News was ask-
ed at what price they would print the
charter for three consecutive issues
in the weekly. A hurried estimate,
without the matter at hand with which
to figure .placed the price at $300 the
News voluntarily agreeing to place a
copy of the charter In the hands >f
every citizen of Shawnee. The cou_
tract was made forthwith, and the <«>f
ftcial copy was turned over to the
News the same night. Publication was
begun Thursday in the weekly as
per contract. The extra copies have
either been delivered or are to be nau
at The News office for the asking. Th-'
charter will be published for three con-
secutive weeks.
When the copy of the charter was
turned over to The News, the Herald
by mandamus proceedings sought to
compel Mayor Stearns to give them
a copy for publication in their dally
at twenty-one hundred some odd dot

It often happens that public calamity
overwhelms private virtue by breaking
down the bonds that hold society to-

"The concrete base is now being laid
on Bell and Highland, and everything
looks good for a speedy completion ot
the "contract."
The new asphalt plant r.f tho pav-
ing company has not, yet arrived, but
is expected dally. It is so heavy that
considerable difficulty in transporting
it is being experienced, a Rock Islanl
train having been overturned by It's
weight. The paving compary is
showing every Inclination to rush the
work.
