There i« a state of nfTairs exist-
in^ in the eourtu of the Indian
eountry that it is diflleult for any
ord it ury individual to understand.
One tiling we can't understand
is why the law covering the sale of
the various tonics sold in the
territory is not applicable to all
men alike. We hear frequently of
meh being arrested and punished
lor selling Rochester Tonic, Cana-
dian Tonic, etc., while other men
are selling the san e goods right
under the nose of the courts, and
are not molested ro otherwise
interfered with. If it is cotrary
to law tor one man tc sell it, is it
not contrary to law for any man to
sell it? We learn that a few days
ago, in the town of Tulsa, every
joint was (dosed up and their tonic
destroyed, the proprietors being
arrested and taking to Muskogee.
The agon t tor.I. I). Iter's produc-
tion, Rochester Tonic, was indicted
and tried several months ago for
introducing and selling this hover
age, and under the instru lions ot
J udge Springer the jury acquitted
him from the box. The prosecu-
ting attorney appealed to tl «
Court ot Appeal* .it South Me Mis-
ter, where the matter is still hung
up. According to Judge Springer
it was not contrary to law to sell
tins tonic, hut many who have
since then engaged in selling it
have been arrested and their busi-
ness stopped, while others continue
to sell without interuption. The
•/overnment issues them license to
deal in these things in the Indian
country, and then arrests them
and puts them in jail for doing (hut
which they have been licensed to
do. This is another queer slate ot
u flairs.
So far tis the law is concerned,
it should be repealed, as it is
detrimental to the country over
which it operates, and is the indi-
rect cause of two-thirds of the
criminal cases that the United
States courts in the Territory are
burdened with, and where one
man s punished for violating this
law, one thousand are not molested
al all. So tur as introducing
whiskey in tho Territory is con-
cerned, the officers of the courts,
perhaps, introduces as much us any
one else, yet at Wagoner last week
an old man known as ''Dud"
Burns was convicted by a jury of
selling half a point of wh key
and Judge Thomas sentenced him
to four years and six months in
the penitential*}, when thirty days
would have been a seve 'o sentence
for so petty an otl'ense—at least it
seems so to us.
We believe every citizen has a
right to buy all the whiskey lie
wants for his own use in any coun-
try, and the law that makes a folou
of a man for purchasing that which
is manufactured under tho laws of
his country is all wrong, and
should bo greatly modified or
abolished entirely.—Fort Smith

An engineer named W. 1*. Staf-
ford, was killed at Oktaha near
Muskogee, liul week. He was
working under his engine when
a car was run against the rear of
tiie train, pushing the engine
ahead cutting off both of his
limbs.
IV. J. Reese's boy, five years old,
was struck by lightning and killed
last Thursday morning while

An explosion occured in tho
mines near South McAlester ill

dian blood. There is no radical
prejudice in tho Territory, and
hence no social stain on u white
man who marries a ball-breed girl
Usually these girls have been sent
to somo good female college in
Missouri or elsewhere, whore fliey
have acquired excellent educations
and on coming hwmo leel them-
selves so much superior to ihe
average young male Indian that
they naturally prefer to become
the wives of white men. Such
unions turn out as happily as it
both parties were ol tho same nice.
One-of my office assistants is mnrri
ed to a very beautiful and highly
intelligent young woman of the
Cheiokee tribe and they are just
as happy us any couple I evar
saw. These 'white Cherokee's,'
I want to tell you, arc as smart a
pooplo as exists in fliis country.
In no respect can you seo any
intellectual differ slices between
them aud tho pure whites and the
offspring of tho two, which will
always boa big clement in the In-
dian Territory, will rank among
tho most intelligent and worthy of
tho entiro population."
ORDINANCE NO. 18.
An ordinance to regulate the
the sale of non-intoxicating bever-
ages, within the incorporated town
of Tahlequah.
He it ordained by tho Council
of the incorporated town of Tahle-
quah 1. T.
Sec. 1. That all persons en-
gaged in the sale vending or dis-
posing of non-intoxicating bever-
ages or drinks in the incorporated
town of Tahlequah shall be requir-
ed to pay lor such privileges the
sum of 825 per month, qu rterly,
in advance, provided however that
this ordinance shall not apply to
any one selling vending or dispo-
sing of soda water, milk shake
Lemonade, or phosphates.
Sec. 2. That any one wishing
to engage in tiie sale of beverages
as prescribed in Section one ot
lb s ordinance except such ns are
therein excopted shall before com-
mencing the sale of same procure
from the Kecorderof said incopora-
ted town, a license, therefore and
said license shall authorise tho
sale at but ono place, and all per-
sons engaged in said business shall
be required to keep tneir place of
business on tho main street in suid
town in the front part of the buil-
ding occupied und shall not allow
any one to enter through the sido
or back doors. No minor shall be
allowed to buy or drink in said
places, nor shall parties so engag-
ed sell or permit a salo to any
drunk person, nor shall any loud,
boisterous or profane language, or
loafing bo permitted therein, and
all persons engaged ill sale a*
abovo mentioned shall be required
to close their places ot business by
10 o'clock p. in. and keep tho same
closed until 0o'clock a. m.
Sec. y. Any one violating any
section ot this oadinancc shall upon
conviction be lined in any sum of
not less than $5.00 aud not exceed-
ing S2A.00.
Sec. 4. That this ordinance
take effect and be in force from and
i alter its passage and approval.

RULING AUAINST INTRUDERS.
Springer's I)ocis i..n that They
Must Go Sustained.
Washington, I), C. Apr. 29.—Tho
intruders in tho Indian Territory
are endeavoring to persuade the
Interior Department to give a
ruling in opposition to tho decision
made by Judge Springer in their
cases. Judge Springer decided
that tho intruders had no property
rights in the Indian Territory, de-
spite the tact that their citizenship
cases were still pending before tho
United States Supreme Court, and
that they must relinquish tho laud
winch they were occupying to
those who have been adjudged le-
gally entitled to take It up. The
intruders want tho department to
hold the ruling of Judge Springer's
court nut operative until after a
decision shall have been rondered
in tho citizombip casus by tho
■Supreme Court.

Secretary Ryan to a letter from
M. M. Edmieton, which is a fair
typo ol those being rocoived, will
serve to show the attitude of tho
department:

ton abandon his purpose of suing
for possession of tho lands de-
scribed in his notice, and for such
other and further relief as may
seem proper.
You are advised horo that tho
department has no authority to
control the judicial tribunals in
the Indian Territory, and tho
judgement of Buid courts can only
be modified or changed by pro-
oesdings thereia, or by appropriate
action by some judicial tribunal
having jurisdiction of tho subject
matter.
