lieve the death penalty should be In-
flicted as punishment for crime and
be says he does not. It seems to me
that he should sustain his position
theory based upon the holding of the . assuni(-f since Acting Governor MeAl-
district court at McAlester and the j PS.r granted these pardons by call-
position of the governor as to the jn t10 iJOar( together and Hie
board of prison control with refer-1 application in each of these cases
ence to pardons etc. that is full of rr lne commutation of death sen-
interest in view of the largo number t nce and have the board officially
of commutations from the sentence of ; mKS thereon and then grant the
death to life imprisonment that have
been made by Governor Cruce. The
theory of Mr. McAdams is that none
of the commutations having been
referred to the board none is valid
parties a valid commutation of sen-
tence. If he fails to do this and is
sustained in his contention now ta-
ken by the criminal court of ap
peals there would be nothing for the
and the courts may re-sentence the trial courts to do but to re-sentence
prisoners. Ills statement Is as fol- the prisoners to death and the war
lows
"Governor Cruce as well as his
counsel. Judge Samuel W Hayes con-
tends that all pardons commutations
and paroles granted by acting Gover-
nor McAlester wh"re no applica-
tion for such pardons commutations
and paroles had previously been act-
fd upon by the board of prison con-
trol are absolutely void. If this
contention Is upheld by the crimi-
nal court of appeals then all the
commutations of sentences from death
to life imprisonment granted by Gov.
Cruce are likewise void as I am In-
formed that in no Instance has he
required any action to be taken by
the board nor was any taken he-
fore the granting of the commuta-
tion of sentence from death to life
imprisonment.
"If Governor Cruce does not. be-
den of the penitentiary execute the
Judgment by electrocuting them un-
less Governor Cruce's successor In
office after first having some action
taken by the board of prison control
grant commutation of senteiioe froin
death to life imprisonment. I hope
Governor Cruce will not. sMft thU

declares Hr. Joseph M. Aiken of

of it." says lr. Aikin. "Any sub-

building is harmful.
"The caffeine and thein in coffee

useful as medicine but not as food.
Tea and coffee inebriety is increas-
