THE MENACE OF THE OWEN BILL

standard for the conduct oi "
timt suits the notions of con

f..n conform to that standard by
excluding from the mails all business
..i.l..ntli.ir on them. There is nnruo
i'i.m or personal relationship
that could not be brought under the
thumb of the federal government on
the same principle.
More public harm flows from distil-
.!. n.. from stock exchanges. Why
not close the distilleries - without
bothering about a constitutional
aniendnient-by excluding them from
the mails? Some labor unions and
some corporate employers stand con-
victed by public opinion of unconscion
able practices. There is exacuy a
much reason for excluding them from
the mails as for excluding the stock
exchanges. In several states the local
pure food laws are Inadequate and
badly enforced. Let Washington set
up a national standard anil compel
observance of it by its control of the

reader may deem it. U a mens
..... u .t nil feasible to carry it
through congress Is much easier than
t carrv it through forty-eight legis-
latures. And when it has been car-
ried through a state legislature It can
l enforced only by e process of
law. w'hlcli involves trouble expense
and a full hearing of the accused be-
fore a jury of his peers; while exer-
cising the power to exclude from the
mails requires nothing but the scratch
of nn official pen. There would be . a
great temptation to resort more and
more to the easy expeditions method.
t -orrect people's morals and busl-
practices. however is no part of the
legitimate purpose of the l'ml Of lice
department. Fraud committed by the
use of the mails Is the main valid
reason for exclusion from the malls.

Washington July 14.-Secretary
statement tonight de
fending the proposed treaty to settle
differences between the United States
and Colombia over the separation of
Fanama. The treaty has met vigorous
opposition In the senate and former
President Roosevelt has attacked It as
a vehicle for the payment or. uiacK
mail."
Mr. liryan declared that regardless
of whether Colombia has a Just griev-
ance against her more powerful neigh-
bor no one would deny that through
the' separation of Fanama the former
country sustained great financial loss
considerably more than the $25000000
which the United States would pay
ti treaty. As to the expression
of regret on the part of the American
government to which opponents oi me
pending convention offer the bitterest
objection the secretary said tins was
almost Identical with a similar ex-
pression In the Dubois memorandum
on the basis of which the Tall admin-
istration unsuccessfully sought to pla
cate Colombia.
The statement follows:
"As the terms of the Colombian
treaty have been published and it is

now belore tne seimic
fallowing statement may assist the
public to form an opinion upon the
merits of the question:
ii R. Should Do Justice .
.Tio nresent administration found
an estrangement existing between the
i cintna .mi Colombia an es
trangement that has continued for
nenrly thirteen years. As the normal
relations between nations is one of
friendship it is desirable that differ-
nC. shall be adjusted and coruia. .e-
latlons resumed. It Is not necessary
. HUr.ws the events which gave rise
to this estrangement because it tloes
no matter which party was nt fault.
The estrangement exists and this is
the fact that must be dealt witn.
"Colombia has all along Insisted up-
on arbitration. It is not the policy
.. ..im. however to settle by arot-
tration questions like those arising be-
tween the United States and Colom-
bia and as arbitration Is not resorted
to the settlement must be made Dy
direct negotiations. Our nation belug
I ii. lnrirer nation and having
refused to arbitrate takes upon itself
the responsibility of doing justice to
Colombia. Not only Is it our duty u
do justice to Colombia but in case of
i.it H to what is just we must re
solve that doubt against ourselves and
in favor of Colombia.
Loss Not Denied
fvdnmbla feels that she has been
n. i..v...L and whatever may be said
as to whether or not this feeling is
justitied. no one will deny that she
..... ut..ineil great financial loss in
the separation of Fanama. llefore the
separation took place this government
offered Colombia S10.omi.uui. lor .:
canal route and $250000 a year for
100 years. This annunlty might be cap-
italized at about $7500000 so that this
government's estimate of the loss suf
fered bv Colombia could not De ies
than about $17500000.
"Hut we have n later estimate to
consider namely that placed upon the
loss by the preceding administration.
While there Is a dispute as to wneiner
Mr Dubois exceeded his authority in
the proposition he made there Is no
doubt that he was authorized to make
!. to Colombia that the United
States would offer as the basis of a
fv if assured of acceptance by Col
ombia $10000000 for the Atrata river
canal route and arbitration of the re-v-r.sinr.arv
interest of Colombia In the
.iimn.l This reversionary interest
vl....l at about $1G000.000 which
would have been the sum awarded to
r'i...hi.i. if the arbitration was decid
ed In her favor. The $10000000 for the
Atrata route-anil the $M.O"0.000 evi-
dently was Intended more as liquidat-
ed damages' than as the price of the
oi r...t-tocether with the vslue
of the reversionary Interest in the rail-
road would amount to $26000000.
Would Make Friends.
..ir rHnl relations are to be re
stored with Colombia they must be
restored cn a basis that Is satisfactory
to Colombia. Friendships cannot rest
upon force; neither can they rest up
on acquiescence in tne power oi .u.6"f
Even If Colombia under protest and
th ludcment of her people
accepted a less sum thaa that which
rfor It would noi resvoro mc
:atlons that ought to exist We must
........... ...oir sense of justice although
hHlini J in'-" - -
a less sum might satisfy our sense of
justice. In every settlement u.e.c
lnUBt be concessions and our govern-
n.ent has not conceded more than the
requirements of the situation demand.
The ratification of the Colombian
in restore the friendly rela
tions which for a century preceding
19(13 existed between Coiomuia u..u t..c
United States. It also will enable Co-
lombia and Fanama to settle their dif-
.. o .! deal with each other
upon a neighborly basis. More than
that It will give prestige 10 u.c
States throughout Spanish-America.
This nation can afford to be Just even
more it can afford to be generous In
the settling of disputes especially
i.v tin generosity It can increase
the friendliness of the many millions of
....rUi nnd South America with
whom our relations become dally more
Intimate."
