plaintiffs in error and J. George
Wright commissioner to the Five
Tribes decided in their favor the
commissioner of Indian affairs approv-
ing his findings. The Oklahoma courts
held that Day was entitled to the
property and todays decision upholds
that finding and overturns the ruling
of the interior department officials.
The claim of Ross to the land hing-
ed on certain alleged improvements
he had made which consisted of plac-
ing fence posts on the land. The su-
preme court took the view that this
did not constitute improvements in
the sense that the statute intended.
Indian Case Reversed.
Washington Jan. 5. The su.'Tem"
court today reversed the decision of
the lower court in Oklahoma by wh!Vi
the M.Uland Val ey Mercantile Com-
pany had obtained jud ment in tha
sum t-f $1065 against George E. Tin-
ker an Osage Indian. The company
is a licensed trader and held a claim
against the Indian for merchandise
wh ch was converted into a promis-
sory note. The supreme court sus-
tained the contention that the trad-
er could not collect more than "3 per
cent of the next annuity which in
this case was $2S0 and that it was
incumbent on the trader to prove that
items in the account in excess of the
75 per cent limit were not credit
granted in violation of the law in the
iiuarter preceding the $2Sfl annuity.
The traders bill did not establish this
fact and the judgment of the lower
court was reversed and the case re-
manded for trial.
